Name changed for this.
Started a new part time job 3 weeks ago. Great hours which suit me in a tiny family run business.
However...
No lying time and paid weekly, but I've still not had any wages, should get them soon, apparently the accountant is a bit slow.
Entitled to a break, but we don't get one.
The owner doesn't give contracts.
Wage slips (not that I've had one yet) are infrequent, sometimes a few months late.
And absolute sweatshop, literally can go all shift without a pee.
Allowed to bring in a bottle of water, no snack, no cuppa, nothing.
I'm absolutely fucked after each shift, but the other 2 members of staff accept it as their lot and say that's just how it is and I should be glad of the job.
Should I suck it up and become indoctrinated into their way of thinking, or as I really want to do, spin on my heel after telling them to shove it? Which would be soooo easy, especially as I've no contract.

What are your hours??

If there are no other jobs then I wouldn't be quitting, but I would be asking on a daily basis where the pay was as that's not on if you've not been paid after 3 weeks.

As for no food, then can you not sneak some in, or make sure you've had a decent meal before starting then something to eat as soon as you finish.

I'd certainly be looking for something else in the mean time...

Krustykrabpizza · 06/09/2023 19:02

It would take about 1 minute of googling to find out much of this is illegal

PonyPatter44 · 06/09/2023 19:03

I'd report the shonky bastards to HMRC. I doubt you'll ever see your wages. Is there truly NOTHING else in your area (care work, delivering parcels, warehouse or agricultural)?

gamerchick · 06/09/2023 19:03

They'll use you until you quit and you'll still not get paid.

Knackeredandpissedoff · 06/09/2023 19:06

There are loads of other jobs, they've just been indoctrinated into a kind of cult along there. I don't want to join it.
I've asked every day about my wages. They should be paid soon/tomorrow /Friday /next week.
There's literally no time to eat. It's non stop. Almost 9 hours out of the house, nothing to eat, water to drink and 1 pee if the desperation gets too much.

If you don't get paid overtime, are you being paid less than minimum wage? If so, then I think that would be a good one to tell the job centre. And HMRC!

Knackeredandpissedoff · 06/09/2023 19:10

There's no overtime. If the job's not finished the others lie on and don't get paid. I bale at my finish time. Minimum wage to the legal penny.

You're legally entitled to a break if working 6 hours.

I suggest you tell your employer that and just take one?

babbscrabbs · 06/09/2023 19:11

Definitely report them

Knackeredandpissedoff · 06/09/2023 19:12

I am legally entitled to a break, but no one is allowed one. He doesn't care. He makes up his own rules.

babbscrabbs · 06/09/2023 19:14

Would he literally stop you from walking out?!

Try it and see what happens

Film it if you can

TiredandLate · 06/09/2023 19:21

Did you really expect people to say 'same, my boss pays me every few weeks, if he feels like it.' 🤔

Clarinet1 · 06/09/2023 19:22

If you’ve not been paid, it seems to me you’d be barely any worse off if you never go back!
The report to all the agencies PP have mentioned. Also, flouting so many rules about pay and breaks could well give you a case for constructive dismissal.

Knackeredandpissedoff · 06/09/2023 19:22

I've never met him. All I know is "I've to justify my wages and they've to make sure he gets his money's worth out of me."
The 2 remaining shifts this week are looking less likely, the more I realise how ridiculous it all is and you all posting to back me up.

OP posts:
Knackeredandpissedoff · 06/09/2023 19:24

I don't expect anyone to say anything. I wanted a bit of moral support, which I've mostly received.

ReginaRegina · 06/09/2023 19:27

Fuck them off!

I'm apart to start a tribunal to claim back £6k in unpaid wages and will then be going after my seven months unpaid pension which I didn't know about until just before leaving. Quite before you reach this stage!

Boopeedoop · 06/09/2023 19:29

Sounds more like the work house than a job.

LittleOwl153 · 06/09/2023 19:29

So you are working through your 'break' allocations? Are you paid for these? Otherwise you are working unpaid overtime...

ThinWomansBrain · 06/09/2023 19:30

Leave
Small claims court for unpaid wages
If they don't come with a proper payslip and P45, report
Report tax fraud or avoidance to HMRC - GOV.UK (www.gov.uk)

Complain about pay and work rights - GOV.UK (www.gov.uk)
minimum wage issues
if you aren't paid for your lunch break and expected to wort through it, but only paid hourly NMW, they are likely to be in breach.

Don't forget that you will also be due to paid holiday.

Knackeredandpissedoff · 06/09/2023 19:34

I'm paid for the hours I work. 7 hours for example, no break and no wages deducted for breaks so I do get minimum wage. It's exactly like a work house. I've never experienced anything like it and I'm not shy of hard work and earning my wage.
It's producing an "artisan" food product, ironically.

It’s a job with terrible working conditions, you’re not getting paid, cut your losses and quit with your dignity intact.

browneyes77 · 06/09/2023 19:37

He is breaking so many laws.

Report his company regardless of the fact you’re looking to leave. Those rules he keeps making up are illegal and he needs to be dealt with.

Sureaseggs44 · 06/09/2023 19:37

All of what you have said is not legal but they will just carry on if no one reports them .

Braindeads · 06/09/2023 19:39

You’re not in south wales are you OP? My daughter got a job in a local village shop / food outlet type place that was the same as this. She got paid when it suited them and they worked her and the other staff like dogs.
Nope, there will be other jobs out there, don’t stand for that.

Knackeredandpissedoff · 06/09/2023 19:39

Any guesses on what the job centre's thoughts will be? I'm guessing I'll be told to suck it up even though it was them who advertised the job.
