If a rented property has a leak which comes in on the ceiling and has left marks who is responsible to paint it? I told my landlord straight away when it happened and she had a roofer come out and the leak is now sorted and it’s dried.

I had a property inspection yesterday and the landlord has told me to paint it as it’s cosmetic work

But getting them to do it is another battle. From experience of trying to paint over a leak like that in my old house it's also bloody hard to do. It's either a specialist primer or a specialist paint so push for it to be done, it's not as simple as a £10 tin of white emulsion from B&Q

Err the rent has to cover the upkeep of the property - it’s not just money in the bank!! Peppery require maintaining. It is 100% his job to sort it and decorate not yours

Please tell me that your deposit is at least in one of the deposit protection schemes.

Also keep records of conversations etc so that you have evidence when he inevitably tries to claim the costs from your deposit.

I agree with the others. Its the landlord's responsibility. However I would offer to paint it if he pays for the paint, materials and something for your time, nearly equivalent to him getting a professional in. He would still be saving money, just not as much as he thought.

I've had loads of landlords and lots of stuff like this happening, and they have always expected me to do it as in the contract, interior decoration has to be done and maintained by me (Despite that none of it has been my fault) I am working on water damage exactly like your photo at the moment - I have filled and painted it but the water stain just comes right through every time. I'm so fed up and wish landlords would "make good" interior water damage. I have always private rented though, and I want to stay here, whereas she could get prospective tenants queueing round the block. Opportunities for rented properties are disappearing.

Document everything in case he tries to take it out of your deposit at end of lease.

Flan lord and he should have sent his insurance people round as that would have been covered -we had leak which caused similar and house insurance covered repair and repainted the entire room and replastering.

Put all communication to them by email or recorded delivery letter and keep a copy. If they think that is your responsibility they are probably the sort of person to try and retain your deposit.

Their responsibility to paint that.

100% landlord. We had this happen when we were renting, the landlord got someone in to repaint the whole room and also bought us a dehumidifier to dry out the damp area before the work started. They were, admittedly, the only good landlords we had. I doubt the rest would have cared about the cosmetic ugliness, but they also wouldn't have expected us to repair it.

This is (probably obviously) ludicrous. You and he have a deal with obligations on each side among your obligations are that you pay rent. Among his obligations are that he keeps the place in good repair.

Let's imagine next rent day you just text to say "I hope you can manage without, I've no more money".

My tenant is happy to do cosmetic work but I never asked, he just said he would do it, sends me pictures and receipts and I pay him for time and materials.

If he hasn't got money to cover these issues he shouldn't be a landlord!

if you want it done, you should do it. Neither of you HAVE to paint it, it can stay as it is for rest of tennancy.
Landlord can't withhold deposit due to it being like that though.

Don't landlord's have to keep properties to a certain standard?

I'd expect landlord to sort it - though they may not do it while you are still there.

But as you could just get a spray tin for about a tenner and hope that covers it rather than repaint whole room.

If it's to extensive for something like that or plaster needs looking at worth following up with landlord because it should be their responsibility.

Hi OP, this is not your responsibility - the only costs tenants can be responsible for are damage they've caused that goes beyond reasonable wear and tear.

You should keep copies of your communication with him, explaining that the leaking roof caused this water staining and had nothing to do with you or your use of the property, and therefore you'd like him to cover the cost of making it good. It looks like there's a chance it will go mouldy if left, which could be dangerous for you, and could devalue his property.

The flip side is that every rental listing round here is SWAMPED with applications... It's dog eat dog out there and people are offering £100s over the price per month and still losing out on places. Everything with property is shit at the moment but being pragmatic, it's likely to be in your interests to not make him think you're a problem tenant.

Is there any way you can get a handy friend to help you fill the cracks and paint it, and then send LL the receipts so that you get the cost of materials back? Maybe that's meeting him halfway?

By the by, your LL sounds like a fairly unprofessional person so can I just check that you have a copy of information regarding which deposit protections scheme your deposit is held with? You should have got this info within 30 days of moving in. Some idiot/lazy/unprofessional LLs will keep hold of deposits themselves instead of depositing them in a protected scheme; you want to ensure yours hasn't done this.

Ain’t he a peach. He’s fully responsible. That needs more than paint, cleaning to see what other damage there is, there are cracks for starters.

If any of my tenants want to repaint my place, say a different colour, I supply them the paint etc. For a small job like yours it’s complicated to get a tradesman. So ask the landlord if he’ll allow you to do the job and deduct the costs from the rent.

Let it fully dry before tackling it.
