Posting for traffic

DP's job and job description does not involve any driving at all. One of his Supervisors doesn't drive (although is advertised as a necessary requirement for his position) and subsequently (very often) DP is asked to ferry this supervisor around in a company van. In doing so he's inadvertently drove in a bus lane on a road he doesn't know at 22:00. There has been a penalty charge notice issued and DP is expected to pay this personally?

This can't be right surely?

Rubbish, anyone driving any company van/car is liable for any traffic violation they have, not the company! No company would pay any of these fines, and the person driving would also get the points on their license if any occurred. Ridiculous to think otherwise.

The solution is really simple. Tell him to pay more attention when he's driving. Bus lanes are clearly marked. The excuse he didn't know the area is at best, flimsy.

He's the driver. He broke the law. He pays the fine.

Unless boss told him to drive in the bus lane

If his supervisor told him to drive in the bus lane and he did then he’s an idiot and shouldn’t be driving anything !

If someone agreed to give me a lift, particularly for work and got a fine when following my directions I would probably offer to pay half. Unfortunately though, the buck stops with your DH.

The driver is ALWAYS liable for how they drive whether in a company van or not. A non driver cannot be expected to know road signs etc regardless of whether they are giving directions or not.

I think people are being very harsh and definitely your DH shouldn't be driving this person around any more. Has he spoken to the supervisor about it ? I would have offered to go 50/50.

@Throwncrumbs thanks, not stupid I can assure you. I just don't drive so have no idea about the laws of the road, bus lanes etc because I've never needed to.

Yes they are. Multiple large signs Which are reflective. Was he driving with no lights on?

Quite - I used to run a transport company hence my surprise at any company who would pay fines for their employees who broke the law.

He's already paid the fine, so it's not a major issue, and i accept i Am BU. But I am going to tell him to refuse to drive the supervisor around from now on. It's ridiculous that he's been doing it for so long anyway.

Your husband sound a wet lettuce , how’s it going to go down with him saying ‘my wife says I shouldn’t drive you anywhere anymore’ lol

OK, it's done. It's been paid. As I said earlier it's up to DP if he continues to drive the supervisor (I wouldnt) and any future costs incurred as a result will come from DPs personal account.

Incorrect I'm afraid. Warnings like those are reflective, not lit for exactly this reason. Your cars headlights illuminated them as you approach.

If the superior refuses to reimburse him (the entire fine) then absolutely your husband should refuse to ever drive him anywhere.

Does the company pay any extra for business insurance on the vehicle?

I have no idea, the only thing I could liken it to was hiring a car when you sign a liability agreement for such instances? As there is no mention of driving in DPs contract.

Why should they do this? The supervisor didn't force him to drive in the bus lane. Its entirely OP's DH's problem.

Should be a lesson learned, but by the way op is defending him that sounds unlikely

Bus lanes are marked. On the road and with signage. Your husband, as a driver, would know this. He fucked up and drove into a bus lane. This isn't the managers responsibility or fault. Your husband, presumably, wouldn't punch someone if told to by his manager?

@Eckyftang when a superior tells you to do something (in this instance drive) and then tells you that you must go a certain way (even though you express that you don't know the roads and would be more comfortable driving a different route). Most people would do as the boss says for fear of repercussions surely?

The liability agreement was made when he agreed to drive him. The morals/legality of whether he should be driving him at all in the first place is entirely irrelevant to DH driving in the bus lane. The excuses you're making for him just make you look belligerent.
