How long does it take to get Collect & Pay set up with CMS?

XH keeps being late with payments and I want it to be more stable. At the moment he just transfers £300 at the beginning of the month but sometimes it’s up to a week late or he’ll threaten not to pay.

I’m not sure but I think he’s PAYE. How long does it take to get Collect & Pay set up? How many payments does he have to miss or be late with before they do it?

I applied for collect and pay in December as exh wasn't paying at all. It's still not sorted out and he's PAYE, I've also given them his full employment details. I'm just going to phone for my fortnightly chase up, the CMS is completely useless

I applied for collect and pay last July or august. It was finally put in place in March . I’ve still not received a penny since last summer.

Apparently the arrears is dealt with separately, it currently stands at around £3k but I'm not holding my breath

Doesn’t it come from his employer @TUCKINGFYP0 or is he self-employed?

I thought arrears would go to court eventually so he’d have to pay in the end, even if he does stall it

I’m pretty sure XH isn’t paying as much as he should too because he’s having them a few days less than the threshold this year

If he is paying they might not do it. I'm on month 5 of absolutely nothing, before that it was less than 10% of amount owed. Currently 6k in arrears. They have said deduction of earning but it's still not happened! The whole system is a joke

Thank u @trevthecat he does pay at the moment but he’s said if I don’t pay him back half for a school trip he’s paid for he’ll keep a month of CMS. Would that be arrears then?

No. Arrears only accumulate from when you open the case. Ones that predate CMS involvement don’t count to them

Those waiting - Depending on who your MP is if they’re decent get them on the case

I briefly worked for CMS and they did jump when MPs that made plain they were following up got in touch. Especially if they were actually easy set ups as the bosses like being able to say they solved it.

Four months then they will collect and pay. You must nag them.
