To ask for correct child maintenance amount??

Hi all, but of back story will try to keep this short. Separated from soon to be ex husband in December 2019, he didn't pay a penny of CMS until July 2020 and offered £80 per month. Went to CMS in March 2022 as I was really struggling with costs for everything for 2 x DS, one is now 12 and other is almost 7. Their dad now pays £190 per month however at yearly CMS review this was upped to £230 per month given his salary increase of £5k. He claimed this was due to high amounts of overtime which he is no longer getting according to him, and he has said he is living on credit cards as he has no extra cash (basic salary is £27.5k). He has now dropped one night per month, so sees boys 144 nights per year which would drop him another CMS overnight bracket. I have had to block his number and block him from social media as he is narcissistic, controlling and attempting to poison kids minds (don't speak about mums boyfriend in front of me, don't let him tell you what to do) for context I don't live with my new partner, have been together 2 years and my boys have only recently met him.

AIBU to contact CMS to advise of the change in overnight stays given his claims he is barely surviving on his salary due to debt? I think I am mostly scared of his reaction, relationship ended due to DV incident which ubfortunately I didn't report to police 😕 if you've made it this far thank you lol x

Absolutely claim. It’s to support your children. He needs to suck it up.

So if you tell CMS you will get more money? How much? If you’re entitled to it then go for it! But only you know what the fallout could be. Are the boys happy to spend time with him??

My sons dad only contributes to 30 pounds a month and has no overnight stays... Claim what u are own but it's a lot more than some people are getting.... Hope everything works out for u

Yes the calculator has estimated on his basic salary with no overtime included, the payment would be £260 per month. I pay for everything, including all wraparound childcare, uniforms, clothes, birthday parties, days out, trainers etc etc. He doesn't offer anything extra towards any life events or necessary purchases for them. X

I understand, it's frustrating even though it's a lot more than I'm getting it's still doesn't cover the expenses of the children... Would be nice if he offered to at least by them shoes or clothes... Children grow out of those so quickly
