Should they pay for a new phone?

Basically a lad in my Son’s school started a fight with him and pushed him into a door and wall and kicked and knee’d him and ended up damaging his phone to the point it can no longer be used 😡 Also said he was going to murder my Son (FYI both aged 12)

I found out who looks after the boy (lives with Grandparents) and spoke to them about this incident. The boy has denied some of this. His Nan said if we can prove he did it she will replace the phone and she is sorry for what happened.

The school have checked on the CCTV and whilst the camera missed what happened because of the angle it was facing, they have said there are a couple of witnesses that seen what happened and in coincides with my Son’s version of events. They have said they are happy to speak to the Nan and confirm this.

I’ve informed her that they have witnesses and she has said she will speak to them however ever since I’ve told her they have witnesses she is no longer responding to me.

Should she replace the phone?

Depending on the value call the police 101 get an incident number then make an insurance claim giving the adults details to the insurance too or small court claim against the adults.

I personally would be more concerned about what the school is doing to tackle the bullying and threatening behaviour than his mobile tbh.

I agree they should replace however the phone would be way down my list of priorities.

I only mention small claims as they have said they would pay if proven and school has witnesses to prove it.

£90 I paid for it recently. Luckily it’s not an iPhone which was his previous phone!

I don’t no, his iPhone stopped working so it’s a £90 phone I bought him from argos recently which I know is not hugely expensive to replace but if it’s not my sons fault should we have to replace it?

Yes I have spoken to them about this and can’t understand how this has even happened on school grounds! My son said he told the teacher what the boy said and the teachers response was ‘oh he was probably just joking!’. Not exactly an appropriate response from a teacher. So yes I have had a meeting with the school about my concerns regarding the threatening and bullying behaviour.

I agree you shouldn’t, I’m sorry your sons is going through this, hopefully the grandparents are decent people and will buy the new phone.

It’s not a hugely expensive phone so not worth small claims but do you think perhaps she was hoping we wouldn’t pursue it with the school and that’s why she said she would replace it? Obviously now the school have witnesses which kinda proves her grandson lied. Even tho she said I can tell he’s not lying 🤨

Yeah she’s not expected you to have proof so she could sit on her high horse if yes I will pay if he did wrong. Now you can prove it she’s like oooo shit. So you can see where he gets his bad side from.

Pretty sure you could still report on the basis of assault though. Maybe she would rather pay up than a possible charge against the boy.
