Shop refusing refund - refund policy unclear at time of purchase

I'll spare the details but DH has been asking for something regularly, something that I could only get in an antique shop. So I got him it for his birthday.

DH kicks off saying clearly it was a joke, etc. Baffled that I've actually got it. I didn't realise jokes that nobody laughed at were repeated so many times, starting with "I really want a..."

DH has called the antique shop to ask for a refund who have said no. Item is not faulty.
I was not given a receipt (only got it today) and wasn't told no refunds in the shop.

After a lot of back and forth with DH the shop offered a credit note. He isn't happy with this as we aren't likely to ever purchase an antique from an antique shop and we'd affectively be throwing the money away.
DH asked me to take it back tomorrow, which I can't do, so he's going to do it...and says he will be quite pushy with the owner in the shop for a refund because if I wasn't told they don't offer refunds then that's their issue, and he plans to leave them a bad review if they don't...

I actually think DH IBVU. Firstly, "joking" that he wanted something about 11 times and getting very annoyed when I then purchased it, but leaving the shop a bad review purely because we have changed our minds as purchasers isn't fair.

Does anyone know the ins and outs of this? Should the shop provide a refund if they didn't say that they don't offer them? They didn't give me a receipt either. The item was only purchased today.

There is also no requirement for a shop to state that they do not give refunds. It would be as ridiculous as having a notice stating they do not allow shoplifting. Both are covered by the law.

Lincslady53 · 29/03/2023 08:35

Oddly enough, they are supposed to have a no smoking sign up, even though that is also covered by the law.

I'd watch his moods in future.

You're doing an awful lot of covering up for him

Can't he just do what most of us do with a present from a loved one? DH has bought me presents that I have wondered "why?" when I've opened it, but I just appear to be really happy with it....I'd hate him to feel I was disappointed.😗

Oh my word, I loved them ❤

YABU for not saying what it is. I don't get it.

Your DH is BU to want a refund, the shop is acting within the law.

I have some glass fishes, they look like Murano but are made in Madeira, 2 out of the three are dead ugly. I like one with yellow in it, I'd be happy to give you one of the ugly ones but collection only , Somerset or. north Somerset . They weigh a ton.

It is a small canon. I hope the suspense was worth it!

I can normally tell when he's joking, we have been together for 13 years and I didn't detect the slightest hint of joke with this...

I did also wonder this. We are laughing about the whole thing now but he still doesn't want it. I, however, plan to hide it in the garden.

Having been in retail management for many years I can tell you that you do not have any entitlement to a refund. Your husband is an ass. The fact that they offered a credit note was good of them. Remember the owners of this business are unlikely to be making much profit if any at the moment, so need customers like your DH like a hole in the head!!
