Shop refusing refund - refund policy unclear at time of purchase

I'll spare the details but DH has been asking for something regularly, something that I could only get in an antique shop. So I got him it for his birthday.

DH kicks off saying clearly it was a joke, etc. Baffled that I've actually got it. I didn't realise jokes that nobody laughed at were repeated so many times, starting with "I really want a..."

DH has called the antique shop to ask for a refund who have said no. Item is not faulty.
I was not given a receipt (only got it today) and wasn't told no refunds in the shop.

After a lot of back and forth with DH the shop offered a credit note. He isn't happy with this as we aren't likely to ever purchase an antique from an antique shop and we'd affectively be throwing the money away.
DH asked me to take it back tomorrow, which I can't do, so he's going to do it...and says he will be quite pushy with the owner in the shop for a refund because if I wasn't told they don't offer refunds then that's their issue, and he plans to leave them a bad review if they don't...

I actually think DH IBVU. Firstly, "joking" that he wanted something about 11 times and getting very annoyed when I then purchased it, but leaving the shop a bad review purely because we have changed our minds as purchasers isn't fair.

Does anyone know the ins and outs of this? Should the shop provide a refund if they didn't say that they don't offer them? They didn't give me a receipt either. The item was only purchased today.

You can be sympathetic and supportive about the situation he is stressed about, but still have a firm line on him not taking it out on you or innocent shopkeepers.

DH is under a huge amount of stress at the moment, this is out of character for him. He still wants to try and go in tomorrow and get a refund though. I have said I'm not doing it.

Bottom line. The terms and conditions of sale in this instance are with the shop.

OP- its for DH to resell- NOT your problem anymore! His fault for being a dick and bully- even if stressed its no excuse, or as you said 'a one off bully' 🙄

Well he's picked numerous fights with you over it, then tried to pressure the shop over the phone and when that didn't work he was ready to go and force them to take it back in person. He sounds like a bully, even if it's the first time you've seen it.

And it could have been much worse...I went past the window of a different antique shop recently that had a cello with loads of taxidermy birds coming out of it. I weirdly liked it.
Did not buy it and this is MUCH more normal than that 🤣 this is on par with a fancy paperweight.

I know, this antique = 2 cocktails on a night out, really not worth the stress! We've just both sat down and laughed about it now although he still doesn't want it

Wouldn't you think for the sake of £20 that he'd keep it (whatever it is) since you've already bought it.
He thought it was a funny joke so can't he just develop the joke a bit now he's got one.

If he's highly stressed he needs to let this one go and not spent time tomorrow trying to get a refund from an antique shop.

He's agreed that he isn't going in the shop, he remembers going in there before and the man being really nice.

I'm tempted not to sell it and to get it out at inappropriate times as a centre piece.

Unless the item is faulty the shop is under no obligation to either refund or give you note. AFAIK.

its only the law if it’s online or over the phone due to distant selling regulations. If it’s faulty you are covered for six months in a store.
