Would you hand over the CCTV footage?

I can't work out what is the "right" thing to do.

We have CCTV on our house, it Covers our drive, back garden and some of the street outside our house (angled to show our front path and front garden but also catches some of the on street parking).

We checked the legality of it all when we installed it but have had endless problems with one of our neighbours objecting to it. They like to purposefully stand in the cameras view to give us the finger and once even came up our drive to spit on it. To be honest its a wider issue as our old owners used to allow them to use their drive for parking and we stopped that when we moved in, they never got over that.

To cut a long story short... they have had someone hit their car outside ours. They have demanded (not asked mind!) That we send them the CCTV footage of the incident. It does show what seems to be a car going too close to theirs, but doesn't show the occupant or the licence plate.

I'll be honest the CFery astounds me, I want to tell them to take a running jump if they think they're getting help from the cameras that they have complained about since the beginning.

I know we have to give someone any stored images of an individual if they complete an SAR, but I don't think that applies here. But then again I feel like I'm creating extra tension (and being an arse) if we refuse! I would give it to the police if they asked but I can't imagine they'll investigate the matter and just say insurance should handle it.

So would you hand it over (after all it is a crime to hit a car and drive off) or tell them to take a long walk off a short pier?

YANBU - don't hand over footage
YABU - you should give the footage

I too would only hand it over to the police or the insurance company.

Bigboysmademedoit · 24/04/2023 14:02

I wouldn’t simply because it doesn’t provide them with the information they need but does give them evidence that you’re recording outside your own perimeter and they will challenge that.

Roz22 · 24/04/2023 14:24

On the basis that FA would come of it with the police in all likelihood, I possibly wouldn’t if I was feeling bitter.

But maybe you could share it to stop them acting like arseholes to make your life a bit easier?

Rosielea123 · 24/04/2023 14:25

I really think the saying ‘no good deed goes unpunished’ is applicable here - I would be wary of providing any footage to them directly because of what they may do with it - try to ‘catch you out’ for storing footage you shouldn’t have, posting on social media, etc. Saying you’ll send any relevant footage to the police if they can give you a reference number seems like more than enough.

"I am very sorry but it's a breach of GDPR to provide CCTV footage without a warrant so please come back when you have one".

This exactly

I’d say I bet u wish u hadn’t spat on my drive or stuck yr fingers up, it must worry u that I could be as petty as u.
then hand the footage over.

The OP is from well over a month ago.

Imagine it's all been resolved by now.

GasPanic · 24/04/2023 14:37

There are any number of feeble excuses you can make up. Pretty much go to a supermarket after you have had your car damaged there and ask them for footage and see what they tell you.

The camera isn't working. We deleted the footage. It doesn't show that area. The download to the hard drive failed. The camera is a dummy. It wasn't connected. We overwrote the data with footage of the dog. The camera overwrites the data after 24 hours. The account save subscription ran out. It goes on. And on. And on.

You can say all the above with a happy smirk on your face.

Itakecreaminmycoffee · 24/04/2023 15:04

would be petty and send them the footage of them giving the camera the finger.

Oh, pleeeeease do this - hilarious!

callthataspade · 18/03/2023 15:41

I would be petty and send them the footage of them giving the camera the finger.

Nah. They can get to fuck if you're going to help them.

Ha!

I might tell them I’d adjusted the angle after their abuse, so it no longer catches the street, sorry.

AlphabetSue · 24/04/2023 15:21

Oh, it’s old. Now I want an update!

Genius, do this!

mellicauli · 24/04/2023 15:34

Well I'd be thinking. They want something off me. What do I want in return?

So I'd say, happy to hand over the footage but only if you agree to put an end to all these driveway arguments, it's not helpful to either of us.

A peaceful life would be your best outcome, surely?

DRS1970 · 24/04/2023 15:37

Give them all the footage of them giving the finger. That should make the situation clear to them.

Iguanainanigloo · 24/04/2023 15:39

Yeah I wouldn't admit to them that your CCTV covers an area of the street, as then they could get you in trouble for that. I'd just tell them the CCTV doesn't reach that far, and deletes any unsaved footage after 24/48 hrs

Emotionalsupportviper · 24/04/2023 15:54

Quveas · 18/03/2023 15:43

"I am very sorry but it's a breach of GDPR to provide CCTV footage without a warrant so please come back when you have one".

This.

They don't like their activities being caught on camera, so why should they benefit if your camera has caught anyone else's?

Only problem is they might up their unpleasantness.

Perhaps you could tell them that you don't keep the footage unless it shows any damage/ suspicious activity on your own property, because that is an invasion on other people's privacy as they go about their day, so you don't have it.

Emotionalsupportviper · 24/04/2023 15:55

Puttingchildrenfirst · 18/03/2023 15:43

That's what I wanted to say, I managed a "well I doubt it will have caught it, after all you told us to move it so it didn't record the road anymore 💁". But they've just asked again to see what was captured ...

They can't insist though. Tell them to do one.

Emotionalsupportviper · 24/04/2023 15:59

mumda · 18/03/2023 16:35

You can give a person their personal data (images)
but you can't give anyone else someone elses.
If the police ask for it you have to give it.

Ask their insurance company to ask you for it.

This.

Pollydolly13 · 24/04/2023 16:00

I would give them the footage but would also include the images of them!

CoozudBoyuPuak · 24/04/2023 16:03

"I am very sorry but I have checked the regulations on CCTV on private property, and it would be a breach of the regulations for me to use the footage for any other purpose than protecting my own property. Keeping watch over my neighbours property is obviously a totally different purpose and I could get into trouble if I were to do such a thing. I therefore have no option but to respectfully decline your request, but in any case even if I could help you, I can assure you that the angle of the cameras is such that you wouldn't get any useful information from it."

Emotionalsupportviper · 24/04/2023 16:05

sweetgingercat · 24/04/2023 12:40

Be the bigger person and just give it to them. Say nothing. Watch the relationship improve. There's no point in making it worse (and it could get much, much worse).

The relationship would not improve.

People like this are so entitled they just accept everything as their divine right.

Every time you "forgive" them a slight, and are the "better person", they laugh in your face and do it again.

SO do I!

I've responded to about a hundred posts and am now invested!

MysteryBelle · 24/04/2023 16:14

Don't give them anything incl the vulgar gesture and spitting because this may be a set up. They may have had someone drive close to their car to look like it got hit, then demanded footage from you to “prove” that your cameras are trained/spying on their areas etc. So don’t be tempted to send the spitting either because it will still give them what they want, “proof”.

Go radio silence on them. No need to respond to them in any way.
