I didn't get cost of living payment from old company

We were told late last year that we would receive £450 in two payments - November and January's payroll. The payment was for cost of living.

My last day at the company was early January. I therefore got my salary plus owed holiday. However no cost of living. I handed in my notice at the company by giving them the required four weeks - but I took the first week in January as holiday (was booked before I handed in notice).

AIBU in thinking I should have received the cost of living payment?

The payment is the same for all staff regardless of hours worked etc. we had to change our tupe contract to get it as well.

I would have thought you would need to work the whole of January to qualify.
Did you get the November payment?

You perhaps should have recieved a percentage for the few days you were there in early January but I don't agree you should have recieved the full amount. It's a scheme to support their staff, you were only a staff member for a few days that month...

You often don't get "bonuses" if you've handed in your notice so maybe it's being treated like that?

Cost of living payments- all the ones I have comes across you have to be actively employed on the date of payment to receive it i.e. whenever your January payday fell at the end of the month.

Wasn't worded as a bonus.

It was a payment to all staff.

My company gave everyone a COL payment but anyone working on notice wasn't eligible. Could be that.

Did they specify that?

My company didn't.

I was told in September I would get £450 in November and January's pay slip to help with the cost of living.

As they didn't specify anything other then "available to all regardless of hours work (eg part time)" I don't know why I didn't get it.

I've never worked somewhere where you'd be eligible for this if you weren't still employed on the payday of the month it was due.

At my work, you had to be actively employed on the date it was being paid and not working your notice to get it. I presume it’s the same for many firms.

Sounds like a discretionary bonus payment so it’s not surprising you don’t get the January one considering you left in early jan. I imagine being on the payroll properly was the first requirement for the payment.

Yes, but you left before the end of January.

I still got a January payslip

We received a COL payment in January, but the company was very specific that employees needed to be in employment with the company on XX January 2023 and not have resigned from their employment before that date in order to qualify.

Was there really no terms given? What about those on sickness leave, dependants leave etc?

But surely they only gave the payment to staff members? You were no longer a staff member when this was paid, so I see no reason to expect them to give you it!

If they added it to your contract then the wording of that is the only important thing here.
