I didn't get cost of living payment from old company

We were told late last year that we would receive £450 in two payments - November and January's payroll. The payment was for cost of living.

My last day at the company was early January. I therefore got my salary plus owed holiday. However no cost of living. I handed in my notice at the company by giving them the required four weeks - but I took the first week in January as holiday (was booked before I handed in notice).

AIBU in thinking I should have received the cost of living payment?

The payment is the same for all staff regardless of hours worked etc. we had to change our tupe contract to get it as well.

At my work you had to be not working your notice and be employed on the payday of that month to receive. No way you would be eligible only working a week at the beginning of Jan, assuming your payday is towards the end of the month.

No I wouldnt expect you get this, you didn't work January. At most I'd have hoped for a % based on the % of Jan worked (so £102 before tax), but at worst no as you were not working there at the point of pay being run.

No, I can't think why you'd believe you should get it for working a couple of days in January. You weren't a staff member when it was paid. Unless they gave it to random people who don't work for them, there's no reason why you'd get it imo.

There will be terms and conditions attached to the payment and you obviously didn't qualify.

You didn’t really.
You got a payslip in January.
It’s pretty standard that you have to be employed on the date of a payment, to receive the payment, unless otherwise specified.
Is your usual monthly pay date within 1st-6th Jan?

Even if you can’t find anything in writing specific to leavers, if it says, “paid to employees in Nov and Jan pay” then by the time of Jan pay (contracted Jan pay, not a final closing out a leaver pay) you were not an employee.

You were not an employee when the COL payment was made, it's that simple.
The only reason you had a payslip in January was to show payment for A/L that you took

I wouldn't have been expecting to receive this. You don't normally get payments like this unless you are actively employed on the date and not working out your notice.

No company I've ever worked at - at any level - would pay discretionary pay to anyone who was working their notice or had left when the payment was due.

Another person who is not at all surprised you didn’t get it. Never worked anywhere that gave bonuses/discretionary payments to people working notice. Getting a January payslip means nothing. My last job I got a September payslip despite having left in August. It was holiday pay they had left off August.

Wasn't worded as a bonus.

It was a payment to all staff.

My old place did things like this often, but you didn't qualify if you were on your notice period

Because she was working for the company, just on normal annual leave. Working for as in employed by, not as in actually delivering tasks.
But that’s irrelevant, because the point is she wasn’t employed (actually working or on leave) at the time of the COL payment.

Aren't these payments usually to retain employees if they may be tempted to look for better pay elsewhere? You had already handed in notice and then were no longer an employee on payday.

I feel this one can be put to bed now; the OP wasn’t actively employed at the time the payment was made, so she didn’t get paid.
