Parking Charge when I didn't do anything wrong

Noodle20 · 27/01/2023 14:20

So I received a parking charge for apparently parking in staff parking at the hospital. The proof they've shown me is 2 photos of me entering the carpark and exiting the carpark.
These are of my car but having gone back today to check exactly where I parked, I can confirm that I parked in visitor parking which has cctv on entrance and exit. I cannot locate the alleged staff parking I was supposed to park in, altho next to the visitor carpark is staff parking (this section does not have cctv at its entrance or exit). I have appealed once and it's been rejected due to lack of evidence so I've been given the option to appeal further.
Is this a waste of my time? I'm already super stressed about it but having to attend hospital on multiple occasions. I always park in this carpark so I'm now thinking I'm going to get more of these parking charges!!

Go back and take pics of the entrance and exit you used. And one of the exact parking bay! Send them off with an appeal..

Noodle20 · 27/01/2023 17:30

Thank you, I've got some photos of where I parked and that it says visitors. I'll go back and get a video of the cameras in that carpark. I can't think how else I can prove I parked where I did. It's clearly a mix up with their footage

Mix up with footage probably breaks terms of use of CCTV. Appeal again and if you fail, check if the Information Commissioner can receive a complaint for mishandling of data.

BanjoKnockers · 27/01/2023 17:35

If they think that you owe them some money then the burden of proof is on them to produce the evidence. You don't have to prove to them that you don't owe money.

Don't pay, don't engage, and let them escalate it through whatever process they have until they reach a judge.

Nit that I'm accusing you, but.trying to think why you'd get a parking fine.....but .....

Could there be 2 entrances/exits; one for the visitor car park and one for the staff car park?
And you accidently used the entrance/exit for the staff car park?

Long shot, I know, just a thought.

Noodle20 · 27/01/2023 18:54

@minou123
I've been back and there's def only one entrance to the visitor carpark which I've used multiple times now and one exit which have the cctv cameras. I walked across to the staff one where there's no obvious cameras to their entrance so I'm not even sure how I'd be seen driving into it.
It's really stressing me out now as I just don't know how to prove I wasn't there. The photos don't even show me parked, just the car entering a carpark (it's very zoomed in so couldn't tell you the exact location) and again the car leaving a carpark

Nah this is crap, sorry. Easy to say from an armchair etc. but in reality? It just causes anxiety in people like the OP who want this resolved.

OP -

I had this at Heathrow airport. I did as a PP suggested and took pictures of what I said I did, challenged them to prove otherwise, and asked for the fine to be let off.

I won through the logic of it. I wouldn’t leave it thought without further reply, because they’ll just take the fine and double it + fees etc.

minou123 · 27/01/2023 19:01

No worries @Noodle20 .

Sorry if I stressed you out. I was trying to think of anything that could explain it and my brain could only think of a 2 entrance/exit scenario.

But clearly that's not what's happened.

As you've looked at eveythumg, I would think they have messed up.
I know its stressful having to appeal, but send in yiur evidence, like other PP have said.

Noodle20 · 27/01/2023 21:35

Thank you all.
I will gather all evidence I can (pictures, map of car parking etc) and plead my case and see where it gets me. It's just frustrating my first appeal was rejected so this is the final one I'll be allowed to do.
Makes me wanna take a photo of where I park from now on as I still have regular hospital visits to make

Thank you all once again

I’d take a photo every time from now on op. Time stamped and dated on your phone.

I'm pretty sure OP will have sorted this by now. thread is six months old!!!

I think the onus is on them to show a photo of you parked in a staff space. So ask them to provide evidence of your car being PARKED in a staff space. Not entering, not exiting.
