Holiday entitlement when leaving

I've worked at my job for a couple of years, and I have a small amount of accured holiday left, it was written into my resignation letter asking for it to be paid out.

I was told today to my shock (I asked to double check they had done it) and was told it won't be paid as holiday runs until April? I've worked my notice and finish this week.

Is this correct that I'm not entitled to the money? I'm my pervious jobs whatever was left was paid so I'm confused.

If your holiday is until April then you would only get a pro rated amount if you leave before April as you wouldn’t. Be entitled to the full year’s annual leave amount.

If it's accrued, you're entitled to it.

What's your annual entitlement and how much have you used since April?

You'll be entitled to any leave accrued from March until your leave date (minus anything you've taken )

You wouldn't be paid out for any holiday from your leave date- end of the leave year

They need to pro rata the annual leave.
So if you get 24 days a year - that's 2 days a month. So if you've done 10 months of that year, you are entitled to 20 days.
A slight over simplification, but thats the gist.

I agree with pp , it depends on how many days holiday you have used and how many youu have accrued.

If like most people you get 20 days holiday per year + 8 Bank Holidays ( more this because of HRH) .

So say you have used 10 days holiday between April and August, you will only have the holidays you have accrued between August and the last day you work , this varies from company to company depending on company policies so you need to check your contract but you will not be entitled to take your holiday that you would have earned until April next year.

If your holiday runs April to April and you get 27 days per year. You will be owed 2.25 days per month. If you have taken 22 days so far this year you will end up owing them holiday. December to April would be entitlement of 9 days. If you only have 5 days left you owe them 4.

In that case they need to pay you that or allow you to use it in your notice period

You say you have accrued it. But they are talking about the holiday year.

As op said, can you confirm that how many day you get a year and how many have you taken.

You’re entitled to anything left of a pro rated amount up to now, not what you would be owed for the year up to end of your leave year in April had you not left.
You say you had a week left, is that from the full entitlement until April or out of the pro rated amount to the end of December?

As pp’s have said if your holiday calendar runs April to April you will not have accrued your full years entitlement by December. So do you mean you have 1 week accrued left (you are owed this) or 1 week entitlement left (you are not owed this)?

So if you have used what you have accrued then you won’t be owed anything.

In fact I have known people that have had their final salary deducted because they have used more than they had accrued by their leaving date

Any holiday days owed to you should be paid with your final salary so that your P45 can be issued & HMRC records correct when starting new job.
