Car accident - who was at fault?

NCasOuting22 · 29/09/2022 10:40

I was recently involved in a car accident where 2 cars collided where the red and blue lines cross on the attached photo.

the left lane has white arrows painted in the road indicating to go straight on and has “petrol” written underneath it. The right lane also has white arrows painted on the road with “exit” written underneath it.

who was at fault?

YABU - blue car at fault
YANBU - red car at fault

I am assuming that the issue is that you were seen as undertaking the blue car.

Wouldn't you have to be on the left to be undertaking?

Namechangehereandnow · 29/09/2022 11:09

Doesn’t matter of any other circumstances that posters are giving above - blue car was in a lane indicated straight ahead only. He did an illegal manoeuvre to turn into a one way lane the WRONG way. I’d be ringing your insurers and asking for exact clarification as to why they’re all backing blue car. Arrange an on-site meeting at the car park if needs be.
Having said that, insurance companies are a law unto themselves at times 🤷‍♀️😡

Explaintome · 29/09/2022 11:09

Yes, what did Blue say that is more plausible?

Crunchingleaf · 29/09/2022 11:09

this doesn’t make any sense. Blue car definitely had responsibility to ensure the other lane was clear before making their manoeuvre.
Can it be appealed OP?

Booklover3 · 29/09/2022 11:10

Definitely blue car

pinkyredrose · 29/09/2022 11:10

Blue was at fault

WeepingSomnambulist · 29/09/2022 11:11

What on earth did the blue car say that was more plausible? They'd have to have told a story about it happening somewhere else.

They turned across a lane, without checking that the lane was clear, and they were turning the wrong way down a one way street. They drove into the aide of your car.

What story have they told?

I think I'd be tweeting the whole thing at the insurance company and arbitrator. Where can you go after the arbitration? Court?

I am assuming that the issue is that you were seen as undertaking the blue car.

That's insane. Mirror, signal, manoevre. It's why you look over your shoulder when turning right into a main road in case someone's daft enough to overtake you.

Aeio · 29/09/2022 11:11

What is their version of events?

Oblomov22 · 29/09/2022 11:14

"more plausible"?
Seriously wtf?
Please don't take this lying down OP. I would fight this. What happens now in these cases? You escalate it? Ask for a review?

FictionalCharacter · 29/09/2022 11:14

NCasOuting22 · 29/09/2022 11:03

I’m at fault at the arbitrator found the other parties story “more plausible”

That’s insane. What was the other party’s story? Sounds like they might have told a carefully crafted pack of lies.

closingloop · 29/09/2022 11:15

Was 'their story' that they were indicating and turning right at the junction, and that you overtook them during their manoeuvre?

pinkyredrose · 29/09/2022 11:15

Is it their insurance company saying you're at fault?

mountainsunsets · 29/09/2022 11:17

Were they mid manoeuvre and arguing you drove into their path?

Cliff1975 · 29/09/2022 11:17

Blue

Dotjones · 29/09/2022 11:17

Blue car 100% unless there's some crucial fact missing like the red car was doing 100mph.

oldwhyno · 29/09/2022 11:17

you'll have to tell us their story, and yours, as there isn't enough information here to make a judgement.

Clem8 · 29/09/2022 11:17

I don't drive (yet), so I wasn't going to comment but I thought the blue car was at fault straightaway. I'm shocked that you are having to go through this at all. I'm sorry OP that sounds stressful!

BernadetteRostankowskiWolowitz · 29/09/2022 11:20

What part of your car and what part of their car collided?

FirstnameSuesecondnamePerb · 29/09/2022 11:20

On your circs blue.
Are blue saying that red moved across their path? If so, tricky If no witness

IsAinmDummm · 29/09/2022 11:21

Is the blue car contesting it, and if so on what basis? It would seem to be to be so obvious who is at fault that there would be no need to ask MN.

CakeMonster1 · 29/09/2022 11:22

Oh wow, that's terrible that the insurer is saying you are at fault when quite clearly the blue car was!

I suggest bringing this to the attention of the insurance ombudsman. İf you get no joy get traffic police to request footage from car park/area the incident took place and request it goes to court.

ancientgran · 29/09/2022 11:23

My husband had a similar sort of thing happen where his insurance company said they were agreeing it as "knock for knock" so both drivers at fault. DH had an independent witness willing to give evidence. DH told the insurance company if they did that he was going to the police as the other driver had committed perjury as his story was lies. Insurance company passed the message on, the police were asked to get a statement from the witness and the other drivers insurance paid up.

I hope you get it sorted, it is so annoying when people do this.

CakeMonster1 · 29/09/2022 11:23

The other driver clearly driving without due care and attention.

fatgirlslimmer · 29/09/2022 11:24

If you have to ask, you must be Blue? 😏
