Car accident - who was at fault?

I was recently involved in a car accident where 2 cars collided where the red and blue lines cross on the attached photo.

the left lane has white arrows painted in the road indicating to go straight on and has “petrol” written underneath it. The right lane also has white arrows painted on the road with “exit” written underneath it.

who was at fault?

YABU - blue car at fault
YANBU - red car at fault

I was involved in a very similar accident about 10 years ago - I was on a dual carriageway and the car in the inside lane cut across me in the outside lane to do a U turn. Clearly didn’t see me in their blind spot, but tried to make out I’d overtaken them unsafely and should have stopped to let them make their turn (they omitted to mention they turned straight across me and I had no time to stop, which was luckily obvious from the location of the damage to our cars, my left front wing and their right rear door).

Went to court, and was ruled to be their fault, for turning across me (obviously, to my mind). If you are the blue car, just give it up. It was your fault, and you need to check your blind spot before you change lanes.

Definitely blue. It's such an odd manoeuvre - turning right across a lane with oncoming traffic the wrong way into a one way road.

It’s a car park area

why did the blue car turn right out of the left lane?
was the red car in its blind spot and the driver didn’t check

The red car was going straight on and the blue car should have waited

100% blue. They turned across the path of another vehicle. Absolutely no doubt they are the ones at fault.

Definitely red because:
the red car and the blue car had a race
all that red could do was stuff his face
he eats everything he sees
from trucks to prickly trees
but smart old blue he took the milky way

If the above wasn’t the case then probably blue!

Blue - A/ they made an illegal turn in to a one way street and B/ they turned in front of a vehicle in the right lane.

I have heard though that if you hit a vehicle in such a way that it can be assumed you should have had time to react and stop that you can be found to be at fault - not that I agree with it but I have heard that.

I'd say just from your OP, probably the blue car (turning across two lanes into an exit of a one way lane) especially as it went across another car.

However it totally depends - was the red car waiting and indicating for a space, then the blue car went around and the red car suddenly started to move? Was there an obstruction ahead so the blue car had to use that entry lane rather than another? Were both cars moving? Were either indicating? Did red park up and gesture blue to go across? Loads of information can change opinions.

If any of that was the case, OP blue car would have said so in the first post.

I am waiting for the drip feed that they were transporting their sick granny, who has SEN, whilst fleeing DV. Or some other load of nonsense meant to make us feel bad for telling her she’s a shit driver.

Thank you. I’m the red car and the blue car drove into the side of my car, damaging my passenger door. The blue car had damage to its front right wing.

the insurance company have decided that I was “fully responsible” (me driving the red car). I had a witness and video footage taken after the accident. Plus screen shots from Google maps similar to the attached.

it’s gone to an independent arbitrator and they have also decided that I was fully responsible.

does anyone have any idea on how to make them see sense?

I definitely wasn’t indicating and waiting for a space,

there was no obstruction that the blue car needed to move around

the blue car was picking up people who were waiting in the car park are that it turned into (after crashing into me)

If the diagram is correct the blue car was also turning the wrong way into a one way bit of road too.

Utterly bizarre this is being made out to be your fault
