I want to choose when I have a holiday!

I don't want the Queens funeral to take one of my days of holiday entitlement. What if I can't attend something I want to go to because I have no annual leave left because I had to take this off. So annoying.

Oh ffs people. It's a public holiday.

You're not required to watch the funeral. You're not even required to give a damn about it. Stay in bed all day if you want. Potter in the garden. Go to the beach. Binge watch TV. It doesn't matter.

Most years people are complaining that there aren't any more public holiday after august. Well bam, there you go and you're still not happy!

Were you moaning this much about the jubilee one, or did you just take the day to yourself.

Seriously people. Get a grip.

It's absolutely legal for employers to count bank holidays in your annual leave and anyone saying otherwise should understand they are privileged if that's not the case for them. In a "normal" year you basically get 5.6weeks or 28 days (4weeks + 8 bank holidays) but we've had two "extra" bank holidays this year, but you are still only required to be given the 5.6weeks so it is one, and now two, fewer days for you to choose when to have off.

Yes but I want to use it at Christmas when my parent is over from Australia

All of these are possible;

  • if your annual leave is "X + bank holidays" without specifying a number, then you will probably get an extra day's leave. Whether you work on the day or not will depend on your employer and whether they are open as usual or not
  • If your annual leave is "X + Y bank holidays" and X+Y is already greater than 5.6 weeks then they probably don't have to give you it. They might, or they might not. This could be an extra day and the funeral day off if they close, or an extra day annual leave to be taken whenever with you still working on the funeral day
  • If your annual leave is specified as "X days including bank holidays" or just "X days", or is statutory minimum, then your employer is not obligated to give you an extra day annual leave. They might (in which case see above) or they might not. If they don't and they stay open, then nothing changes. If they don't and they close, then you have used up one of your annual leave days.

Well considering we don’t know what you do how can we answer that question?

If you have a job where you can wfh then assume you can say you would rather work. If you work in a shop that’s closed then probably not

Where I work full timers will get the extra day
part timers will either get 1/2 a day in lieu if they don’t work Mondays or will owe employer 1/2 a day back if they do

There are definitely companies which will be closed on the 19th with no option for staff to work, and will take the day from their employees annual leave. Not sure what happens to those who don't have any left (as taken or booked) as I imagine is quite common by September.

It all depends on whether you have holiday entitlement plus bank Holidays or including. If it's including then you need to take a day of your entitlement to cover it. If you've already used up entitlement then you take it unpaid.
