I recently sold my house. It’s been sold, mortgage paid off, new people living there since mid august but I still haven’t received my share of the sale. I’ve emailed and rang my own solicitor a few times since Monday and was told I’d have an update Wednesday. Heard nothing. Emailed again this morning and got no reply. Would it be unreasonable to ring again demanding an answer as I need this money to go towards another place for me and my kids. First time I’ve sold a house so I have no idea if im being fobbed off or not but it’s so frustrating at this stage

Are you in a chain? We broke the chain for our last house and received funds the same day (what was left after paying mortgage).

Dishwashersaurous · 08/09/2022 14:50

You should have got the funds the day they were transferred. Before you handed over the keys.

Why did you handover keys before getting the money?

partygate · 08/09/2022 14:50

Ring and email (so written record). Funds should have been transferred within around 24 hours of completion. Absolutely keep chasing and escalate if they don’t respond within 24 hours

purplecorkheart · 08/09/2022 14:52

Sorry I am a bit unsure but have the buyers paid and the Solicitor has not released the funds to you? Or have the buyers not paid.

I

YellowPlumbob · 08/09/2022 14:52

I’d be escalating this today.

Iguanainanigloo · 08/09/2022 14:54

You definitely should have got the funds when keys were handed over, if you were moving straight into another property you would have needed the money to be able to move into the new house, so what on earth are they playing at?! I think you need to get answers asap, as could be something ridiculous like they've paid into the wrong clients account. There is no reason why you shouldn't now have your money I'd the new owners are living there!

Yes they’ve paid the house is theirs since mid august. My solicitor is saying she’s still waiting on the solicitor who handled the sale to transfer the money to her

Just re read and they moved in mid August?! This is insane op, there can't be a single valid reason as to why your money hasn't been released yet. I also would not have handed over keys before receiving the funds. We've bought and sold numerous times, and always got the sale money before completion. I don't understand what your solicitors are playing at, but I think someone potentially has made a huge costly mistake, and your money needs to be found asap.

SometimesMaybe · 08/09/2022 14:58

You should have the funds immediately on the sale. Phone them back straight away as if you don’t have the funds today you will need to make a complaint. Link to Law Society (if you are in England) www.lawsociety.org.uk/public/for-public-visitors/using-a-solicitor/complain-about-a-solicitor

Dishwashersaurous · 08/09/2022 14:59

I don't understand. No one should have given anyone any keys until you had the money in your bank account

girlmom21 · 08/09/2022 14:59

Our solicitor told us we owed them money and would have to pay before completion. They miscalculated and actually owed us money and took 2 weeks to pay it.

Keep hassling OP. It's your money! I'd go to the office and refuse to leave until you get it.

burnoutbabe · 08/09/2022 14:59

sounds like some sort of maybe divorce sale? so house sold and money sent to solicitor for say husband and then need to transfer money to wife after that.

Yea that’s it exactly but still waiting a long time when the money has been with his solicitor who dealt with the sale, since mid august

Sprig1 · 08/09/2022 15:05

Your solicitor must have a formal route for escalation of complaints. Call them now, ask what it is and use it. This is ridiculous.

Dishwashersaurous · 08/09/2022 15:06

Oh OK. So money has come from the sale. But it hasn't got to you.

Formally complain to both sets of solicitors

What do they mean by this? If your solicitor didn’t handle the sale then who did?

There is either a very big misunderstanding here or a very, very serious problem.

Who did your conveyancing for you, and to whom are you speaking now? Why are they different firms?

This is wrong OP, funds good to the seller’s solicitor on the day of completion. I’d be very worried something has gone horribly wrong-contact the firm’s managing partner asap

Dishwashersaurous · 08/09/2022 15:14

So it's not the house sale. It's that your ex husband solicitor hasn't given your share to your solicitor. What is in the divorce agreement

TooHotToTangoToo · 08/09/2022 15:18

Your solicitor shouldn't have transferred your house for the new owner until they'd received the funds from the busters solicitor:m. Go and camp out in their office and demand to speak to someone high up. You should have received your funds shortly after the sale, days, not months

TooHotToTangoToo · 08/09/2022 15:19

Buyers solicitor, not busters

That the sale is split between both of us

Andromachehadabadday · 08/09/2022 15:25

Buyers opacities should not still have the funds.

Your solicitor knows this. I would guess they are lying.

We has this, the solicitor had the funds but, apparently only transferee money out on certain dates. I Google the firm found the most senior person and complained to them. It was transferred in an hour.

newbiename · 08/09/2022 15:25

She can you escalate to your EXH solicitor?

newbiename · 08/09/2022 15:25

*So can you

Fireflygal · 08/09/2022 15:28

Do you have a financial consent order? I.e a document that has been signed by a judge?
