Mileage allowance out of maintenance

Dss's mother is a lazy cow. DP has always paid above the minimum recommended payment guide from cms. She is begging for more money from him even though we are struggling immensely financially. She is claiming everything under the sun so she doesn't have to work. I know that she has fiddled things so she gets more in benefits, I would love to report her for this but it would impact dss so I won't.
My question is whether DP can claim petrol costs for picking up and dropping off out of cms payments. The current costs are crippling us. How much would he be able to claim? She will not help with transport, it's 45 min drive.

Thank you

"More than the CMS minimum" could be as little as £8 a week, the minimum being £7.50.

notalazybitch · 28/08/2022 15:49

Thank you all.
There's no court order in place and no cms arrangement so I think that is the first thing to put in place.

Could your DP have DS 50% of the time ?

Not true about the minimum., I get £7/week Grin

Isaidnoalready · 28/08/2022 15:51

Just pay what is due and no more as you know its less than what he is paying now

notalazybitch · 28/08/2022 15:52

@UserError012345 unfortunately not due to school and distance. We would have him all the time but she would never agree to that

UserError012345 · 28/08/2022 15:52

And how much over is he paying ? Is it a lot ?

Tibtab · 28/08/2022 15:53

Is the CMS minimum + what you want for travel equal to what he is paying now?

notalazybitch · 28/08/2022 15:53

Yes it's £60
A month over

OP posts:
notalazybitch · 28/08/2022 15:53

That's a lot for us, we have other kids

OP posts:
UserError012345 · 28/08/2022 15:54

Not an awful lot over then. If it was £100's I'd say get it relooked at.

Why is DP 45 minutes away ?

notalazybitch · 28/08/2022 15:55

@Tibtab no he's paying more than that

OP posts:
cadburyegg · 28/08/2022 15:55

If he's already paying more than the minimum then the obvious thing to do would be to reduce the payments to a more affordable amount, rather than split hairs over petrol.

I'm curious as to why you think the mum is fiddling the benefits system when the DWP ask for proof for pretty much everything.

notalazybitch · 28/08/2022 15:55

They never lived together

notalazybitch · 28/08/2022 15:56

I can't say how I know as it's too outing. She definitely is though and it infuriates me

You could apply for 50% ...nothing stopping him. He might have to fight for it by the sounds of it. That's one way of solving it.

Could you move nearer to him?

BabyDreamers · 28/08/2022 16:11

He should pay the minimum amount. Its not difficult.

SunnyD44 · 28/08/2022 16:16

Has it always been like this or did she move further away?

I don’t know why he’d live so far away from his own child and then moan about the distance.

notalazybitch · 28/08/2022 16:17

I've explained already

OP posts:
notalazybitch · 28/08/2022 16:17

We can't move nearer for to our children being in schools already

OP posts:
RandomMess · 28/08/2022 16:19

Just go via CMS and pay what is due.

If you are struggling now presumably it's only going to get worse so you need to?

Sunnyqueen · 28/08/2022 16:24

notalazybitch · 28/08/2022 16:17

I've explained already

No you haven't.

I really don't see how you could possibly know 100% she is fiddling the system unless you filled out the forms for her.
You seem really venemous towards her, even putting your username notalazybitch, yikes! 😳
Just go through cms that is what it's there for.

SunnyD44 · 28/08/2022 16:25

How come DP lives so far away from his son?

notalazybitch · 28/08/2022 16:31

@Sunnyqueen they were in a very short term relationship years ago, never lived near each other or lived together.

You seem lovely yourself Confused

RunningSME · 28/08/2022 16:31

So basically you do the bare minimum and the money makes up for lack of parenting whilst he spends time with other children?
And youd like to reduce that ?
