To think my friend is wrong and this can't be classed as stealing?

Whenever I order a home delivery from Tesco I always get a refund on stuff that they have substituted in exchange for what I originally ordered to get money back and to keep the food, sometimes when I genuinely dislike their substitute choice or sometimes when I just want some money back.

My friend said "that is what is known as stealing". I replied "HOW can it be stealing when I call up and ask for a refund and it's at their discretion if they give one or not?" Also, I used to work in a few call centres and so probably speak to people who work at call centres politer than most other people, so that might factor their decision to give me refunds.

Unless someone tells me that they work for Tesco on the call centres and they are obliged to give everyone a refund that asks for one but they will later be punished or sacked for it if they say yes, then I can't see what the issue is if they say yes? I don't shout, or threaten or rant. I ask nicely and they say yes. If they were to ever say no, I'd simply say "okay then" and that would be that. So how is it stealing?

I just can't believe in this day and age someone would begrudge someone free food. Their tagline is "Every Little Helps". This is helping me. If they didn't want to help, they can easily say no. Or AIBU and out of touch?

Things do not become moral simply because someone allows you to do them. After all, there are people who reply to advertisements for voluneteers to be killed and eaten.
The person who placed that ad said, just like you, 'well if they didn't want to be eaten, they could have said no.'

May someone answer this simple question: If a person asks to be refunded for something from a company and the company says yes and also says keep the stuff you are asking for a refund for, it's no bother, then what part in that chain of communication is the stealing part?

Also, for the thousandth time: I do not get delivery sheets and I only get email receipts after delivery.

And I do food I dislike delivered to me to foodbanks. I don't understand why someone on here would think I would lie about that to strangers that I don't know.

At least if you get an online delivery you can not get id'd at the checkout and end up crying in Tesco toilets which will give you oodles more time to start lots of edgy such fun threads on here

I'll bite and answer you question: when you are dishonest. So basically any time you fancy some free food/ refund as you stated in your OP.

Do you tell the person on the phone that you just fancy some free food?

Are you confused? I personally dont think "TWAW" and I was pointing out people were being unreasonable in their confusion of not knowing I was male in the other thread when I had pointed it out several times. Have you got me confused with someone else/another thread?

I say along the lines of: "I ordered xxxx item and you sent me xxxx item as a substitute instead, I didn't want that and don't like it, can I get it refunded please?"

It's not such a simple question is it though, because no-one else who has Tesco delivery doesn't get email receipts prior to delivery. It's their system, regardless of what postcode you live in. And there are numerous other ways to find out what substitutes you have been given - e.g. ask the driver (as he 'runs away from you' - that's very telling in itself 😂)

It's very telling of a poster who's either an arsehole or on a wind-up mission to
a) ask AIBU then disagree with everyone who says yes
b) say they're flouncing off leaving the thread and proceed to interject every few subsequent posts

I eat/use most of the products after refund has been confirmed. If they are anything I don't like or can't use I give to foodbanks.

Then you are being dishonest by saying you don't like it when asking for a refund.

So to answer your legal question: this is theft by dishonest/ deception which is now covered under the Fraud Act.

You could:

  1. Download the Tesco app and see your subs on packing so you can inform the driver you don't want them
  2. Request no substitutions on your order

Both will solve your legal dilemma, however I have a feeling you won't do either

I have literally never been asked, once.. Why would I lie about this one particular point when I have been open about everything else? I have never had a receipt before delivery, only after.

Of course the receipt comes after purchase. But you can access your order confirmations and subs list prior to delivery by logging in on the website and via the app

May I ask, how often do you do this? You must have very poor luck with subs to make this worthwhile or for it to even be brought up in conversation.

If I were having so many subs issues I'd either change supermarket or opt for not subs.

No, i probably won't as I'm quite okay with myself and my own morality for what I'm doing and if Tesco didn't/doesn't like it they could have/will stop me doing it in future at any time. I'm honestly not sure what the big deal here is but, choices I get. Anyway, I'm out!
