2 men hire a surrogate to have a child for them via IVF. They wanted 2 boys (had names and gmail accounts for them already🙄).
The IVF clinic implanted a female foetus, and now they are suing the clinic.

I don't think they should be allowed to raise a child they clearly don't want.

YANBU babies arent commodities. They should never be bought and sold, and being female is not a defect

Do you think if you were faced with medical malpractice you wouldn't sue?

The clinic messed up, they owe for that, especially as sex selection is very costly. At the very least they should get that back.

Do you also think the thousands of women who post here about gender disappointment shouldn't be allowed their children?

Id be happy for all surrogacy to be banned internationally. It's never done in the best interests of the baby. And yeah they shouldn't be allowed to raise a baby if they really hate the fact she's a girl that much. It's like they think they've been sent the wrong pair of shoes or something.

Nope, surrogacy is legal in Denmark as long as the surrogate uses her own eggs and doesn't accept payment.

I don't think they are monsters to be suing for a medical mistake - they were told they could select the sex, and it didn't happen.

I do think they are monsters for paying to rent a woman's body in the first place. And I don't think misogynists make great fathers, especially not to girls.

The statement from the clinic is cute enough isn't it? Making it about the couple not wanting a girl instead of about them promising a boy. If it's so distasteful to select sex why did the clinic agree?

Regardless of my feelings towards surrogacy this clinic promised something delivered something else and I feel they're right to sue. it's not like the clinic is doing it for free- also they're the ones profiting off surrogacy, not the couple so it's interesting that you only take issue with the couple and not the clinic.

I thinking 'not allowing' this couple to keep their child — of whom one of them is presumably the biological father — is a bit much.

The clinic presumably indicated that they would implant male embryos, as per the couple's request. For whatever reason they didn't do that.

If it was an issue, either medically, legally or ethically, surely this would have been tackled at some point during the process, allowing the couple to either go elsewhere or accept that they might have a daughter?

I have complex thoughts about surrogacy generally, not to mention the capitalist healthcare system of the US where you can literally buy better outcomes.

But the basic gist of this case as stated, and within the confines of the process that's already happened, I don't think it's unreasonable for them to sue.

I’d happily ban surrogacy, it’s a vile industry. Remember reading about a paedo buying a child in this way. When the mother found out he was a paedo, she wanted her baby back, but she was told no. Poor victimised paedo got to keep the baby he purchased 🤮

The clinic made a mistake. The parents are entitled to sue for that mistake. That doesn't mean they won't love the child. It simply means that they paid a lot of money for a procedure and that procedure was not carried out correctly. It's medical malpractice.

Similarly, if parents had paid for screening to avoid certain genetic conditions, they would be entitled to sue if the clinic didn't carry out that screening correctly and their child was born with one of those conditions. That wouldn't mean the parents didn't value or love their child and shouldn't be allowed to keep it.

Well, yes that means "commercial surrogacy" (ie renting a woman to procure a baby) is banned, across the EU seemingly.

You're referencing "altruistic surrogacy", which is on a tiny scale in comparison to the industry in the US.

I agree this doesn’t look good - but lots of people have gender preferences. If they paid the clinic to select a boy then the clinic is at fault. It probably seems harsher now because the couple are making statements to support their case.

hopefully They will be good parents to all their children.

After many, many years of trying to have a baby of their own, my neighbours had a baby via a surrogate.

They are the most fantastic, loving parents and I'm very happy for them and their lovely child.

Surrogacy is just a way to help those who cannot have children in the natural way become parents. I'm saddened by what seem to be homophobic comments on here. If you have natural fertility it doesn't matter if you are a drug user, abuser or general piece of shit you can have your own child and unless you mess up in a pretty spectacular way you will be let in peace. There are massive hurdles to get through to be able to use a surrogate, and the women who provide this service deserve to be very positively regarded for what they do.

Surrogacy should be illegal, it’s awful.
However, putting that to one side this clinic made a mistake and should be made to apologise for that. As for compensation that will show how much boys are valued over girls.

Yes we do. They're suing the clinic. The little girl will know that they didn't want her. It's all over the internet for God's sake!

This really exposes how disgusting surrogacy is. Commoditising human being is a sick practice.

I think surrogacy is, for the most part a grim practice, and think it should be banned with the exception of very specific circumstances.

I just feel so sorry for that little girl. If these men get their boys, will she be raised the same way, or will she be shunned and pushed aside?

Will she have the same opportunities?
Will be be treated the same?
Will the precious boys be expected to do the same sort of chores ( if they have them) as the girls?

I can’t see them doing that. She will always be second best

The child was born in 2021, so can’t be any older than one. That seems a bit young for the child to be able to articulate whether they are male or female, so maybe they should wait until the child can confirm their pronoun preference and gender identity before they sue… ;) /sarcasm

In the UK we can't pay for babies via surrogacy, but many still wax on about it on MN
