Is it justifiable?
As a means to escape?

OP posts:
Toottooot · 24/04/2022 13:05

Why have you nae reported this individual to the polis?

BeforeGodAndAllTheFish · 24/04/2022 13:05

Nobody can detain you for 4 or 5 hours except the police:, and even they need a reason. Are you saying they held you in a room with no explanation? That's called false imprisonment and is a crime

That might be technically true, but if you went to your GP or counsellor or other medical appointment and told them you were going to kill yourself, and they detained you whilst seeking help for you then I dont think that GP would be arrested for false imprisonment, do you?

The way the OP writes, this sounds like she was detained because she was a risk to herself or others and needed help. If she assaulted a medical professional to get away then it would just make her look even more mentally unwell.

Thats not true, a registered mental health nurse can detain you on a section 5.4 for up to 6 hours and the police for upmto 24hrs if they feel you are a danger to yourself or others and a health professional may feel it appropriate to keep you in hospital if you are acutely unwell and unable to keep yourself safe

NerrSnerr · 24/04/2022 13:16

You need more context. Is it a healthcare professional? I can't think of any other scenario where you wouldn't just call the police as you've said it wasn't a security guard after shop lifting.

Butfirstcoffees · 24/04/2022 13:23

I am also guessing op was held for her own or others safety. Which is why she is being cagey, changing details but is insisting she needs to go back.

She wants MN to advise her its ok the attack the person doing their job.

BlanketsBanned · 24/04/2022 13:31

No its not ok to hit a health professional who is legally doing their job in the patients best interest but it happens all the time and few people get charged, if you are mentally unwell or under the influence then they take all that into consideration . .

Xpologog · 24/04/2022 13:43

AFAIK a security guard could only detain you long enough for police to arrive. And they have to state why you are being detained. If the scenario was female detained on suspicion of shoplifting and there were only male security people they cannot search her do have to detain the person until police arrive, which could take time.
Of the person is in a position of authority ( security, store manager e.g.) and you believe they detained you for their entertainment or on some pretence then it’s essential you speak with a solicitor or senior police and do not go back to wherever it is alone.
Best I can offer on info you’ve given.

Lockheart · 24/04/2022 13:48

OP, your post history suggests you're suffering from several things and you've spent some time in hospital recently.

If this is in a healthcare context then no it is not acceptable to assault a doctor or nurse who is keeping you in hospital for your own safety. If you believe they are acting unprofessionally or you are being held unlawfully then you need to speak to PALS or contact the police.

DaphneSprucesPippasClack · 24/04/2022 13:49

There is nowhere near enough information in this post for anyone to help you. If you have been kept against your will then you have reported it to the police, yes?

And why would you go back again?

SpindleInTheWind · 24/04/2022 13:51

@JetTail is there any way you can be accompanied on this next visit to the place?

TheFuckOffCar · 24/04/2022 13:57

If you could be more open about the context of being held against your will, then we may be better able to advise.
Just tell us who was blocking your way and where (supermarket, shop, hospital etc) this was being done.

Hutchy16 · 24/04/2022 14:03

Someone hasn’t paid their dealer 😂

Walkingalot · 24/04/2022 14:16

Only going by your previous posts. Assuming it's a health related setting then there are usually signs up stating that they will not tolerate any level of verbal or physical abuse. I can not imagine any scenario however, that you would be prevented from leaving, unless it was for your own safety or safety of others.

SirGawain · 24/04/2022 14:16

This is getting a trifle tedious. Cleary the OP is not going to explain the circumstances and is just stringing us along.

Dealwithit · 24/04/2022 14:31

I was trapped in a room where I was assaulted, abused and verbally sworn at and they blocked my exit repeatedly unable for me to leave. I did not have a phone.

I was with my line manager and her line manager they trie to placate the person and failed. I was not allowed to leave for about 2 hours. I ended up in hospital with chest pains - neither of my line managers phoned the police and I was told the people that did this had been banned etc
I had months off work and it was seen as a problem. Management lied repeatedly to me.

if it happened to me ever again I would phone them police - report it what do the police say - false imprisonment etc?

pinkstripeycat · 24/04/2022 14:44

If someone kept you cornered for 3hrs that’s false imprisonment and illegal on its own.
I seriously doubt if you hit someone to get away from false imprisonment it would not even be considered an issue.

benevernomore · 24/04/2022 15:04

I had a colleague who was a jury in a murder case in scotland. The woman murdered her male partner. She was acquitted as the law said you have to flee if you can, but if you can't they accept you can use force to defend yourself. As she had children in the house the jury judged she could not flee her partner when he physically assaulted her.

ICannotRememberAThing · 24/04/2022 15:07

Can you be prevented from leaving a hospital under the mental health act?

sweeneytoddsrazor · 24/04/2022 15:09

But the OP was held by a professional somewhere it wasn't a partner

justchecking1 · 24/04/2022 15:09

@ICannotRememberAThing yes, and under the mental capacity act

moderntile · 24/04/2022 15:10

ICannotRememberAThing · 24/04/2022 15:07

Can you be prevented from leaving a hospital under the mental health act?

Yes. I was held against my will for over 6 months in a mental health facility in England . I was not a danger to anyone nor did I assault anyone. I was very mentally unwell with a very very rare reaction to a medication. It was hell.

DysmalRadius · 24/04/2022 15:11

I'm sorry you've been in this awful situation and I understand why you feel you can't share all the details. Is there someone what you can take with you today to make you feel more at ease? Is it an official scenario where you could say that you wanted to record the interaction on your phone? What would make you feel safe?

RosesAndHellebores · 24/04/2022 15:21

OP do you have anyone in rl who can advocate for you?

Pixiedust1234 · 24/04/2022 15:33

If you have to return to the same place make sure you have another person with you. Cant help with your question as you haven't given any details. There are too many instances where it wouldn't be okay.

Herejustforthisone · 24/04/2022 15:36

OP, are you well supported at home? This all sounds a bit odd.
