It's a parking one

We live on a small development. At my end it's a cul-de-sac with 5 houses. We all have our own parking spaces/drives and there are two visitor spaces. Which were clearly marked with small metal visitor signs (the other area for visitor spaces still is)

Two neighbours have decided that because these visitor spaces are within their boundaries that they aren't visitor spaces. However, in everyone's part title transfer document they are clearly marked and there is a whole paragraph clearly stating they are for visitor spaces for everyone who has a part title transfer.

The neighbour removed the signs and have since used the parking for their own cars declaring that each of them own that space (so, one each, even though both neighbours have two spaces)

Now, I have sent them a copy of documents (they have the same one) and explained that although something might be on your land there are always things like shared driveways, access and parking exemptions. Both neighbours have seen the document, acknowledging they saw them, but haven't commented or conceded. One of the reasons I bought the house is because it had visitor parking really close, so this is all really annoying.

AIBU to put the visitor signs back on? Or should I wait until they concede?

Does the development have a management company? If so, address it with them?

It does have a management company. I have asked them to put them back on and I keep chasing but have not had an answer.

I wanted to do it by stealth but so many people have a Ring now I can't get away with it Grin

Where do residents park? If they were still labelled as visitor parking, is there anything stopping a resident parking there anyway? We have spaces on our estates that have a V on them, but they are basically just in allocated spaces rather than visitor only spaces.

Just put the signs back on and if they challenge you inform them that you sent them the documents which state they are for visitors and that you are just reinstating them.

I wouldn't hesitate to put them back up. Then refer them to the management company.

Definitely get back on to the management company. If they establish constant use for just themselves it will be a bigger problem letter. Put your letter in an email to the company and cc it to your partner so they know you are keeping a record

Residents have driveways and garages. So I have a garage plus a space in front for another car. So space for two cars. The two neighbours have double garages and two spaces so enough for 4 cars each!

There is nothing to stop anyone using the visitor spaces. As always those are based on good will and (I thought) everyone understanding their legal documentation! But clearly not!

Are they parking in the visitor spaces when their driveways are clear? If so, I'd assume they've decided to remove the sign and park there so they can argue it belongs to them further down the line.

Well quite, it's what I and the other three neighbours are concerned about.

It's why I wanted them to concede.

I am sorry for breaking the diagram rule, I am out at the moment but will post one asap.

Wait for them to move their cars and then you and other considerate concerned neighbours put your own cars there.

Repeat daily if necessary.

We have this on our estate. Residents go and scream abuse at visitors who park on the visitors' spaces because they consider them theirs. The management company have sent lots of letters which have made no difference. They say they will paint them with a V, but I doubt it'll make any difference.

So whose title deeds are they on - who actually owns the spaces?

To be honest I doubt you'll get far with the management company, once the plots are all sold they couldn't care less. You might have better luck with the council planning department who approved the development.

Could you ask the management company or council to reinstate the signs AND paint 'VISITOR' on the ground?

@eagerlywaitingfor they are on all our title deeds in terms of rights to use for visitor spaces.

In terms of boundaries they are within the two neighbours who are disputing they are visitor spaces. This happens a lot because no one wants to leave small pockets of land under random ownership, but I don't think it's widely understood that there are also sometimes access rights etc over that land that's within someone's boundaries.

It's also really clear between the council and development company what they approved.

@StepAwayFromGoogling I have done that, and chasing them but so far not had anything back to confirm they will replace them.

Oh and the neighbour said that the fixings had rusted through and had removed them but said to another neighbour that the management company had agreed they put them there by mistake so removed them etc etc but I checked, the management company didn't remove them and had no knowledge of them being removed. Confused

The management company will have made an agreement with planning with borough council about visitor spaces

Maybe worth contacting the borough council or copying them into emails you send stating you are concerned that visitor space signs have been removed by NDNs and two NDNs are claiming the shared approved visiting parking spaces as their own property

@verytiredofbeingshoutedat yes exactly and this is what I also attached to the pack of documents I posted to the neighbour. As well as a copy of my own title transfer document. I mean it's all really clear but my neighbours have not conceded that.

Which is why I am asking whether AIBU to just put the damn visitor signs back on!
