We rented a house for two years and moved out in January. As a family we've moved out of several houses before (in London, so £££) and I thought I'd got it down to a tee. I paid for the full expensive clean (was nearly 800 quid, including carpets, ovens, windows etc.). This was guaranteed, so any problems would be rectified by the company. Before moving out we allowed viewings (they were selling), which I don't normally do but they had been very good to us as LL. These viewings continued after we left and are still ongoing now as it's not sold. I had several conversations with the LL about the state of the property and offered to get an odd job man in instead of paying for the inventory (cost is about the same) but he said no they preferred to do an inventory. All fine with me. At the end of the tenancy the ll returned out deposit in full, without question. Great, I thought, and fair too, as we had paid all our rent on time and allowed unlimited viewings. Now, two months later, he has sent me a list of damages totalling 2k (including cleaning faults) and asked for my thoughts. AIBU that he has taken away my right of redress through the deposit protection scheme? I'm aware I could do nothing but it might fester on and if he really wanted to he could take us to small claims. There are some silly things on the list like two broken light fittings for 300 quid each and gardening at 50 per hour.

I would have paid reasonable deductions from the deposit, but why repay the deposit and then do this?

@WineAcademy, this is what gets me, they're not actually going to spend that money on repairs! We lived there for 2 years, paying our rent on time, solid profit for them as I know when they bought the house and how much for. The rent we paid would buy a house outside of London!

@chesirecat99, I booked an end of tenancy clean that would satisfy the inventory check and I bet it would have done if he'd had an inventory check done, because the floor looked clean if you didn't know what colour it was supposed to be!

I could get a quote done but I'm guessing the TDS won't let them charge 50 per hour for cleaning?

it's not even about the money any more Grin

just popping back as I'm about to click send on my submission to the deposit resolution service, I want to make sure I get it right - am open to all advice and all egging on Grin

@chesirecat99, you gave me brilliant advice on this thread, the gardening section is a joy to behold.

I have abundantly set out that the house was empty and viewings were continuing for 6 weeks after we handed back our keys at the end of the tenancy. I think this will take care of the cleaning and probably the gardening stuff.

The cleaning company returned as a goodwill gesture and met the landlord who gave them a lot of grief and said they should have brought a polishing machine to clean the floors. They have written in an email that they have never heard the like of his expectations.

He still wants 900 quid for cleaning.

I'm not sure what to do about damage, whether it's better to deal with each individual claim for damage, or at least the bigger ones, or not accept liability because the house was empty so long and he could even have had someone living there!

Why are you even entertaining this, you've been gone since end Jan and you said in your original post that you'd had your deposit back - what can he do if you dispute it?

Hi Fuckyou, a further post on the thread clarified that the money we'd received back from the EA wasn't the deposit, it was an overpayment of rent.

@swiftt, I'm guessing we stopped the standing order went through and they immediately realised and paid it back? In any case, when I emailed him to thank him for paying our deposit back promptly (it should be paid back in 10 days) he didn't say anything!

Your ex-landlord is a CF.
When the tenant goes, you owe it to them to sort everything out ASAP. And honestly, after two years, a sane LL will expect some wear and tear anyway, and to have to give the garden a bit of a tidy up.

I very much doubt that the deposit protection scheme bods will entertain this. IME they are very fair.

chic - this is dreadful and weird of him. I have never heard of anyone handing back the deposit which in effect means well done -the place is perfect and then trying to argue the opposite including with the cleaning company who anyway have guaranteed their work! If he still wants £900 for cleaning as the cleaning company would pay he will need to deal with them.

Good luck with it all. When my son's tenants handed back his house at the end of last year I gave them the whole deposit back even though we had a lot of work to do as they had a complex situation and one had gone back abroad. I would never consider raising things so much later after the deposit was returned.
