Just got a speeding ticket and no MOT

Just got a speeding ticket. 62 in a 50. I was on a motorway diversion and I've just checked and the MOT ran out on the 16th, 5 days before the offence. I've now got the car booked in for this week but I'm really panicking. What can happen?

No MOT means your insurance was invalid, so I’d assume a large fine for all three offences.

Just pay the fine online , no one asked about MOT when I got done . It was a £100 I think

I just got a letter saying notice of intended prosecution I haven't been offered the opportunity to pay a fine yet. Is notice of prosecution normal? I'm scared I'm being taken to court.

Take a deep breath. Get it MOTd and wait and see what they send back.

No MOT can mean your insurance is invalid. Check your insurance.

So, if you admit the speeding, you could get up to 6 points, a driving ban for up to 21 days.

The MOT could bring a fine, £1000.

And you need to know about your insurance. That would be the worst case scenario.

But no amount of worrying will change what has happened. Work on what you can and try and stay as calm as you can

Do they check you have a valid MOT when issuing a speeding fine?

62 in a 50 you will be offered a speed awareness course. I had the same on M6 in roadworks.... 64 in a 50. (I was just following speed of traffic as the speed kept changing from 60 to 40, 50 etc....)

Does the letter just say about the speeding or does it specifically say about the Mot? I thought there was a 14 day window for MOTs but not sure why.

They can be harsh (like AIBU) but much more knowledgeable than Mumsnet and will sort you out

I work with insurance companies. It does invalidate your insurance as a technicality. However, typically they reduce their payout by the cost of an MOT or if grossly out of date then a percentage. Probably shouldn't be sharing that info but it's 100% true. If the accident you have is caused by an un maintained car, they wouldn't pay out if you have MOT or not.

Isn't the NIP the one where they ask the registered keeper who was driving at the time? So you tell them it was you and the next letter is the one telling you if it's just a fine or something else?

That is the usual wording. In the letter there is a notice for you to sign, for you to confirm you were the driver and return it.

Do that and they will send the penalty back.

No mot doesn’t invalidate your insurance. A car hit me from the side on a roundabout and when I checked the number plate I found the drivers MoT was a few weeks out of date.

As far as I know there was no consequence to him. His insurance still paid out to me.

I don’t think an out of date MOT is a big of a deal as people assume.

You write back saying who was driving and then they send you back a letter with the option to choose a fine and points or a course (happened to me last year ). Its pretty straightforward unless you don't reply to the letter.
In regards to the mot I can't see them checking whether every car that has been caught speeding has a valid mot but you will just have to wait and see I suppose.

Hello please don’t panic. Get your MOT done on Monday. You won’t have to go to court unless you are disputing it. You will get offered a speed awareness course and you will get a fine. Don’t worry about what hasn’t happened yet. Make sure your are fully insured, MOT, Tax, Service in the future. You will be fine.

They need to know who it was before they send the fine/points/court letter as if the driver already has points or is newly qualified then the process is different to when it's a driver with a clean licence

You have an NIP. At that speed the absolute worst you will get is three points and £100 fine. You may still be eligible to take the speed awareness course and you will easily be able to google the limits at which it changes.

You should get your car MOT'd within date though. You literally brought this on yourself by not looking at the road signs or taking them seriously and not maintaining your car as you're legally required. Just don't make that mistake again.

If anything, its more reason to check. If a driver has broken speeding laws, what else could they have contravened?

Notice of Intended Prosecution is what they send so you can send back the information about who was driving at the time. E.g My husband was caught speeding in the car that is registered to me and he is a named driver on so I sent back his details and he got the fine and points.

They then send a letter to that person with offer of awareness course or fine depending on the circumstances.

I know it's stupid of me I take full responsibility. The tax and insurance don't run out until June and I assumed the MOT was the same - so stupid.

I've filled in the form saying I was the driver so will post it back and wait for the next thing. They haven't mentioned no MOT it's just I've realised. Do you think they would have mentioned it by now or wait until I wrote back saying I was the driver?
