Just got a speeding ticket and no MOT

Just got a speeding ticket. 62 in a 50. I was on a motorway diversion and I've just checked and the MOT ran out on the 16th, 5 days before the offence. I've now got the car booked in for this week but I'm really panicking. What can happen?

If you have an accident due to a vehicle not being maintained the insurer will settle the third party costs as RTA insurer but the owner of the vehicle will be liable for those costs. Just in case people don't know. Get those tyres checked .

Why do so many MNers post incorrect legal advice? If you don't know what you're talking about then don't post. It's unhelpful and possibly dangerous or damaging.

The speeding is 3 points £100 fine if you accept it when it comes once you've confirmed you were driving.

SJPN fines and weekly income, etc, are utterly irrelevant if you don't contest it.

No MOT is a £100 fixed penalty non-endorsable (no points) but you won't be getting that because being caught speeding is irrelevant to your MOT situation.

Don't believe everything you find on Google. Even the DVSA have been known to post bullshit about expired MOTs automatically invalidating your insurance.

It's completely dependent upon the policy wording and in any case wouldn't invalidate 3rd party cover and hence you wouldn't be prosecuted.

I found it quite useful when the MOT deadline was extended due to Covid and then the extension ceased. Unusual circumstances that can catch out even the more organised (although the OP doesn't appear to be organised in the slightest).

Do they check you have a valid MOT when issuing a speeding fine?

It's massively area dependent. There's no national rule about this.

I've just read an entire report about this, and there is a massive issue with people not realising their MOT's are not valid post COVID restrictions–The police are being advised to give a warning and you have to present your new MOT (within 7 days) to the station. Depending on your area and location, this is national advice to the police.

No MOT means your insurance was invalid, so I’d assume a large fine for all three offences.

This isn't true, but it is a common misconception. It may be your insurer spells out insurance is invalid without an MOT, but otherwise it all hinges on roadworthiness, which is not necessarily dependent on a current MOT.

It won't invalidate your insurance unless you have an accident that is due to the vehicle not being maintained (brakes, tyres etc) but that's the same whether you have a valid MOT or not.

Also, if it's you've not done a speed awareness course in the past 2 years you'll likely be offered one (you're within the range). I recently did one and honestly it was fine (and actually really informative), although I was amazed by how many people think the national speed limit is 40mph haha.

Don't stress, just get the car booked for one!

That is the usual wording. In the letter there is a notice for you to sign, for you to confirm you were the driver and return it.

Do that and they will send the penalty back.

This. It happened to DH. It’s the usual form. Sign it, send back and do the course (you have to pay), they are all online at present too.

They should check and see if the OP has committed any other crimes too. Check the local CCTV for any assaults and find out where she was at the time of any unsolved murders. There's really no way of knowing just how awful a human being she is if she's willing to go over the speed limit. I bet she caused the Covid outbreak. She was probably the captain of that ship in the Suez Canal as well.

I did a speed awareness course 12 years ago, and was told 10% + up to 8mph, so that would put the OP in the running for a speed awareness course.

The course itself was really interesting, and not at all preachy and the policeman who delivered the first half was really fit

The threshold is generally 10%+9mph for a course so that’s likely to be what you’ll get, it’s a minor speeding offence. Don’t sweat the MOT, they won’t even check it, just get it sorted. I’ve been pulled over without an MOT before and they didn’t even realise, didn’t even do me for the speeding for which they’d pulled me in the first place!

Sometimes morotway speeding offences don't give speed awareness option and you have to take points and the fine.

To be honest, when I had to do the speed awareness course I found it useful. I started annoyed because I was 'only' doing 37 in a 30 zone. But when I heard all the stats about the difference if you hit someone at 37 compared to 30 I was shocked. It has changed my driving a bit. I try to go in 3rd gear through 30 zones now.

Easy to forget to tax or to mot or even to insure. But you just have to find a way so avoid forgetting. I think I get texts about the mot coming up from my garage that I use and the DVLA send out the tax reminder which is useful. You can sign up for some kind of MOT reminder too I believe.

I don't wait for the insurance reminder as it only comes about 2 weeks before renewal and by then prices are rising. If you renew the day before it's due and look on comparison sites the price can be over 50% more than if you renew about 3 weeks before.

I don't think you'll be followed up for MOT. Once, I tried to insure my car and couldn't because I'd failed to MOT it...turned out to be 4 months. It's since then I've set up the reminders .

IME it is rare for the police to prosecute for no MOT. I have sat in court for numerous speeding cases and no insurance cases but the police do not appear to pursue lack of MOT with the same vigour.

They indicate a band A fine (typically 50% or weekly income) and 3 penalty points for doing 62 in a 50mph limit.

As you can get an MOT done up to one month before the due date it is worth logging it on your phone/online calendar a month/3 weeks before the due date to remind you.

Op have you checked that your csr hasn't got the automatic 6 month extension on mot...not sure how this works in England but where i am i had it automatically applied to my car...
