To be angry there is no school place for my son?

I have been told that there is no place for my son in school. He has SEND and 2 parents are key workers. In year 7 at secondary school. They've told me there is no place for him as they've had to prioritise children of critical workers.

Im very firmly in the camp you only send them in if it's the only option and absolutely necessary. And that schools should be capping numbers because we all want parole Wink

And it's pretty obvious you meet that criteria but even worse you met it and were being refused spaces when other children had them. I was rooting for you from my stay at home campsite Grin

But surely if they can work around it they are not "entitled to a school place"? School places should be an absolute last resort.

That is clearly not what either the law or the guidance says. It is ridiculous that people in critical worker roles should be expected to put their jobs in danger or work without pay, let alone that vulnerable children should be expected to regard the support it is accepted they need as a "last resort".

Noone is suggesting her role isn't a key role for society. It is just NOT a critical.role.

@MotherExtraordinaire, I have quoted what the guidance actually says which makes it perfectly clear that OP's role is regarded by the government as a critical role. Why do you keep ignoring that?

Not "maybe not", certainly not. The person who wins is the person who reasonably asks the school to comply with its legal duties as set out in statute and the government guidance.

If the local authority had said I wasn't entitled to a place I would have accepted that. But I would have known I had tried every route and could have documented it to show my employers

I wonder if the supposed “non critical” (according to MNers) workers like OP should just go on strike and see what happens. Then, perhaps othere could see that some professions may not be treating Covid but are actually critical. Hmm

@santabetterwashhishands I think the problem is all schools are interpreting the guidance differently. I'd get onto the SENCO and the safeguarding lead and ask what extra support they can give to you and your son. They were great last week when my son was isolating due to testing positive.
If you still don't get answers you are happy with, approach your local authority.

I think the problem is a lot of school don't currently have enough standing staff to maintain school bubbles of smaller, safer, numbers, which is what they're supposed to be doing, when everyone still want their kids in school.

Mines said the same, but his SW rang to say she had a form to fill out so he could have a place, and neither me or DH are working atm. Do u have a disability SW you can ask?

Some schols apparently have 50 % of pupils attending. What then is the point of closing? If you can keep children at home do. Thats not having a dig at anyone. Just because ones entitled to take up a place doesn,t mean one should. But if you need it then use it.

Perhaps not in England, but in Scotland it is made very clear that school places should only be used if there is absolutely no alternative

@LadyPenelope68 I think I you'll find you were One of them. Apparently these jobs aren't critical to society. Neither is protecting the vulnerable in society, but there you go, that's your opinion.

You’ve already said they can’t take your son due to number of “critical” worker children, your job does not come under that category. You are probably classed as keyworker, but you and your husband are NOT critical workers. Of course he should have had a place from the start, neither of you can work from home, can't be furloughed if employed by the government (and also you are needed). Some people's expectations on here a little bit high on who should qualify for a place. Glad its sorted.
