Don’t even know where to start.

I’m a little worried that what I’ve posted so far makes me recognisable but what I’m going to post makes the sellers from hell recognisable so I’m not sure of the best way to go about it.

Give a brief purely factual statement, if only so that the estate agent puts you at the top of the list to see anything before it hits the websites.
And send a suitable friend in to make a huge offer on the old house and then vanish.

As far as I know, if an agent has marketed your property and it sells, they’re entitled to a commission

For example, if there’s a board outside and someone approached the vendor in the pub and agreed to view it and then buy it, the agent could say that if not for the board, the purchaser wouldn’t have known it was for sale and therefore they have a right to commission

These arsehole vendors are using his photos! He can easily prove that he acted to sell the property and that his property (the images) are being used to sell the house. Added to this the correspondence between solicitors, your statement.

I’d say the agent has a good case for taking them to court.

I like Caramac bars, very pleased to see it make a reappearance although I've only been able to find it in a couple of places, sadly not including my usual supermarket. To be honest it had been so many years since I'd had one I couldn't really say whether it had changed or not.

Caramac buttons, on the other hand, for some reason seem to taste quite different - kind of greasy. Maybe it's to stop them sticking together in the bag, or maybe it's my imagination. They make me cough too. Probably the evil palm stuff.

Definitely provide the statement. Although the seller is having a laugh if they think they’re going to sell it for £75k above the price they originally marketed it for aren’t they?

Oh, should I say something about the house situation? My feelings are that the statement should not take much time or trouble so why not do it? It doesn't commit you to giving evidence in court. I doubt the court would actually be interested in what a disappointed potential buyer would be able to say beyond the bare facts you would already have supplied.

But if it was only you in the running in the first place, and they apparently had to make up another buyer to put the price higher - why do they suddenly think they will get people buying it for £75k MORE if they market it themselves??

Not sure they totally understand this selling business - if your item has limited interest, you put a higher price on it?! Unusual tactic Hmm

Is the house valued at the 75k increase tho? My guess is family friends have said to them that their house is worth so much more than what they agreed to sell it you for, and thus they thought they can get you bidding higher and when you didn't play they have just listed it elsewhere and gone awol. By now they must know you've pulled out as the EA would've left them a voicemail right?

Feel terrible for you op, hope you find a even better house in a better location x

The new ridiculously inflated sale price may be to account for any offer being less than that, but still more than they squeezed out of OP.

Utterly outrageous behaviour. But people serious about buying in a certain area won't be fooled by the relisting. People will recognise it, especially if they're using the EA's photos!

I would provide the EA with a statement, he must be absolutely fuming.

I think, in your situation, I'd be inclined to do the statement and just see what then happens. Giving a statement doesn't commit you to being involved in any future dispute or litigation and would be good to support the EA who does seem to have played things with a straight bat.

Definitely write the statement it will take a few minutes and these vendors deserve to be sued for breach of contract by the estate agents.

When you do find another house, please post and tell us. Nothing warms the cockles more than a happy ending.

My last house buying was 10 years ago. Viewed 2 properties which were identical (same builder on an estate) viewed one of them a second time as it was in a better position, but lost out to another buyer.

Asked for a second viewing on the second property but was told the property was temporarily paused and I could only view it if I made an offer beforehand. WTF? I explained it was a second viewing and asked if it was paused because they had submitted a planning application to extend it? The EA said what planning application? So I emailed them the link whilst I was on the phone. They were in shock, had no idea. I told them I was not willing to put in an offer before viewing it again. We were at an impasse.

Luckily another house came on that day, we viewed it, loved it and have lived here for 10 years.

Please do the statement, it will be your revenge and please include your costs incurred - mortgage application, legal and survey and emails chasing contracts with the solicitor - (redact info such as private email address etc.)

Give a statement for sure. I get that it's a fair amount of bother but they are such assholes they deserve it. Means they'll lose even more money and probably end up having a house they have to sell for less than you offered. What a shame...

Kind of hope they have seen these threads, they'll know now everyone hates people like them.

Do give the EA a written statement.

In a few months' time you can check on the address on Zoopla and can see what they eventually sold for (if they ever do)

If they have listed directly themselves, it's a good job for them you are not nasty so don't get a willing friend to view the house, offer a little over asking for exclusivity and thennproceed along the process, stringing along the vendor until the point of incurring costs. It's a really good job you have not taken this personally and rinse and repeat with different friends.

I would not normally say this as I really do not like EA due to being ripped off several times, However I would write the letter to support the EA in this case, I think u have had a lucky escape as there would probably be more stuff you would find later on from these stupid sellers. They need to give their heads a wobble in the current market. Just chalk it up to experience I'm afraid.
