AIBU to continue running away from this house purchase?

Don’t even know where to start.

I’m a little worried that what I’ve posted so far makes me recognisable but what I’m going to post makes the sellers from hell recognisable so I’m not sure of the best way to go about it.

Very late to be finding out there is a boundary issue in the whole process if you were supposed to close last week.

I wouldn't be impressed with your solicitor OP.

I should preface the following by saying that it's much easier to be pragmatic and philosophical when you're the other side of a house purchase. But ten years ago, we found our dream house and fell in love with it. Lovely EA, nightmare seller (and another buyer interested). We kept bidding up, the EA was incredibly apologetic after each new offer but Mr V had changed his mind again and now wanted another £10k. After increasing our offer by £50k in increments, we finally withdrew and left it to the other buyer. Surprise surprise, Mr V didn't accept their various offers either (he resented having to sell the house) and the sale was shelved. We bought a house that needed a lot of work and we felt was a compromise by comparison. A couple of years later, Mr V had no choice but to sell and someone finally bought the house.

Roll onto last year and the house came back onto the market. As we still had it our minds as our dream house that got away, we were quite excited and scheduled a viewing with the intention of making an offer. It had been beautifully decorated but we realised we liked it far less than our current house and we'd distorted its "perfectness" over time.

Motto of the story is that, although it's really hard to see it at the time and house buying is very emotional, things tend to happen for a reason and you might end up with something far better and not have to deal with undeserving sellers.

@Quandaries completely understand. Must have felt nice, but I much prefer the thought of wasting their time and getting their hopes up just to ring them with the great news that you're not a fucking idiot 😂 impressed you're very strong, I would have been tempted to put in a lower offer.

If you still love the house and half the garden isn't included now, id make an offer at £20-30k less than your previous offer.

I think that reduction isn't commensurate with the diminution in value now that the garden is a fraction of the size it was.

I think you've had a lucky escape, tbh. Imagine if the spurious new buyer hadn't come along, you'd have been really looking forward to moving in, it would be all going smoothly and quickly and then you'd have found out about the owners being (unsuccessful) garden thieves.

You'd have been broken hearted, because you'd have been so much more invested in it.

They're not just CFs, they're stupid CFs.

The problem is the Solicitor would not have seen the garden so would have no idea the size or shape. It is up to you to check the deeds before everything goes ahead.

Agreed. Our solicitor picked up the teeniest tiniest garden boundary discrepancy so I'm also surprised it wasn't found sooner.
