Follow-up to www.mumsnet.com/Talk/am_i_being_unreasonable/4041606-AIBU-to-walk-away-from-this-house-purchase

Don’t even know where to start.

I’m a little worried that what I’ve posted so far makes me recognisable but what I’m going to post makes the sellers from hell recognisable so I’m not sure of the best way to go about it.

it turns out that half of their garden isn’t actually theirs. I don’t know how, but the land actually belongs to the council but they’d fenced it in to their garden ten years ago so now need to rectify it.

Grin they really are CFs through and through...

The only rectification is to unfence it, and let the council take it back. They weren't quite smart enough to gain adverse possession.

However, they now have 2 problems. Not just the shrinking footprint. There's also the question of what could happen to the land the council has just been gifted. What are they going to do with it ? Which is certainly a question I would want nailed down before I bought a house.

I really wish you would have sounded really excited and told them you would need to speak with your partner.

Then be unreachable for 4 days.

Then reply as stated 😂

MzHz · 15/10/2020 17:37

Mwuhahahahah

Blinder @Quandaries

You’ve played an absolute blunder!

MzHz · 15/10/2020 17:38

Fuck it!

BLINDER!!

stillsomewhatsheldonesque · 15/10/2020 17:44

How very generous he was to be giving you 24hours of Exclusivity.

I wish you had done what user suggested too though!

Bullet dodged. Lucky you.

Think I've found it Grin

Oh, I am so glad there's been a resolution! Excellent use of the Arkell case there Grin.

ProfessorSlocombe · 15/10/2020 17:50

@cheesecrack

Think I've found it Grin
That's the one Smile

Well worth digging into the whole case and story, just to really annoy the immortalised Arkell once more.

Possibly Richard Ingrams high point as Private Eye editor. Although Goldenballs is a close contender ....

Well done OP.

I remember educating our conveyancing solicitor on the above mentioned case when our feet-dragging arses of buyers FINALLY completed, having been "unaware" that a deposit would need to be paid over at exchange. This was MiL's flat that we owned & she had died a couple of years earlier. It dragged on and on; our solicitor was wonderful. The case came up when the buyer finally moved in then got their solicitor to write threatening to sue us for missing window keys. There were 3 windows in the flat and at least 1 had a key. I looked online and keys were around £2.50 each. Hence the Arkell vs Pressdram response. Our solicitor replied with it to theirs and did not charge us for it - it was the best letter she wrote all month apparently. Six years on and we never heard another peep from them.

I was tempted.

When we heard their solicitor wanted to get in touch, we figured it might be with news of the other buyer pulling out. I did toy with the idea of keeping them dangling for a few days, but I just didn’t want to give them the satisfaction of anything but a very firm fuck off.

Christ! They really are the gift that keeps on giving, aren't they?

GU24Mum · 15/10/2020 18:25

The sellers have definitely got their just desserts with this one!!

VeryLittleOwl · 15/10/2020 18:26

Absolutely perfect ending to the saga, thank you for coming back and updating us, OP!

But if it’s any consolation, I did sound very excited when I was telling them to piss off.

DeRigueurMortis · 15/10/2020 18:30

Wow.....

They will struggle to sell at all with that issue never mind at £75k extra.

Bullet dodged OP and I loved the classy reply 👏

prettybird · 15/10/2020 18:31

Do come back again and let us know when you've found your perfect forever home. Which you will Thanks

And congratulations on telling them to fuck off. It must have felt very satisfying Grin

OnCandyStripeLegs · 15/10/2020 18:38

The council, you say? Do you think they perhaps might like to be reminded they own half a garden?

Perhaps the estate agent would like to pass that nugget of info over.

AhNowTed · 15/10/2020 18:40

Fabulous update.

They really are scum.

Eddielzzard · 15/10/2020 18:58

OMG what CF's! Stealing land from the council too! And thinking they'd get away with it Hmm

If it wasn't for their greed, they might have too.

Many many congratulations OP.. your will of steel paid off... I do so enjoy a happy ending 🌺

EasterIssland · 15/10/2020 19:15

Omg ! What cf. hope it was also coming with a price reduction the 24h exclusivity ! Also ... wasn’t this picked up when you were doing the purchase by any of the documents you have you do ?

Chicchicchicchiclana · 15/10/2020 19:23

Your solicitor hadn't done a great job re. the garden if you were on the point of exchanging on that property?
