Is this Fraud?

NC - I would say medium-term member (been around for a couple of years)

I work for a charity (this may be important), not massive, but not very small either.

Every once in a while we get an allowance to do something sociable - meal out with drinks, or an activity or trip away (very rarely). There is usually a limit on this. An example would be this week we had a budget to go out so we did Eat Out to Help Out in a very socially distanced way. The deal was we could expense our drinks until 8pm and then after that it was from our own pocket.

Now, we have someone working for us who is self-employed - they are paid through their self employment rather than as staff. They also happen to be friends with our Trustees and several members of very senior staff (all of who disappear fairly early on at staff events).

This is the bit I think may be fraudulent. They are encouraging / asking staff to expense the card receipts to our work, and keeping the till receipt and putting it through their own self-employed company expenses as entertainment.

I hadn't seen it until tonight but apparently this has been going on for the last few years. I don't know how it works with us claiming it back through expenses, I've always had mine paid (but have never been involved with this and didn't get involved tonight). I am assume for charities there's some tax break to and it should come out of the staff expenses with the tax break going from the Charity we all work for.

However, I do not really know. I am probably not going to do anything about it but I would just like to know for future reference if it is indeed fraud.

Hmm that definitely sounds dodgy, but I used to be self-employed and I am pretty sure you cannot include entertaining receipts - www.gov.uk/expenses-if-youre-self-employed/marketing-entertainment-subscriptions unless I have misinterpreted it.

Apologies, maybe self employed was the wrong phrase. They have their own company and are employed through that company.

Oh I see. Yes I would say same receipt being expensed to two different companies is minor fraud.

But hey I am no expert !
