Aibu for expecting to be included in redundancy talks?

Hi so I have a union and he’s been meeting with my boss/HR for redundancy.

So I’ve been stressed generally at work and CV didn’t help. Told boss, he wasn’t much help. Took a week holiday on his suggestion and was than notified of redundancy.

I couldn’t cope so I got a sick note from my doctor (all year they kept on offering me one).

On a side note I’m supposed to be getting NHS treatment this month for depression and would need an hour or so of work to attend. So I told my boss this before redundancy as it would be classed as reasonable adjustments, obviously work had to agree and it’s a disability.

Company asked me to see an Occupational Therapist which I although though was to help me with workplace stress. Straight away she called my GP and she wrote a report saying I wasn’t fit enough to undertake the consult for redundancy.

So my union rep has been meeting with boss/HR and they’ve told the union rep the job is redundant. Ok no worries.... but why aren’t I getting invited to these meetings? I’m getting the information second hand.

My union rep said it was because the company were worried about my fragile mental health/trying to protect themselves. But they are still undertaking the redundancy i don’t understand.

Obviously work had to agree - as in they needed to agree to give me the time of work.

They aren't including you because your GP has said you are not fit enough to take part (you have said so yourself in your post).

Who said you were not fit to attend the meetings? Your GP or OH?

Your union rep’s attending on your behalf though.

Your union rep should 100% spoken to you about this in advance of any meeting. Did you agree the rep could represent you without you being there?

You can't have it both ways, you are either fit enough to take part or you aren't and have chosen a rep to, well, represent you.

If you have changed your mind or don't feel you are being included enough then you will need to let them know. They are just going by what you've said to the medical professionals.

You could ask to see notes of the meetings and receive updates via letter if you don't feel up to attending the meeting, but want to be more involved?

Hi I don’t think I’ve worded my post correctly.

The OP was for work related stress. I have never said the redundancy was the reason for work related sickness. So I don’t know why she wrote I wasn’t fit to undertake consultancy.

People can come back of sickness early, as long as their work agrees. I gave them an option of a job I could do that wasn’t stressful. I don’t know if this is being conveyed correctly.

You sound like you're surprised to actually be treated as a person affected with stress and depression, and expected the employer to ignore that. What did you think woud happen when you finally took that opportunity of a sick note, that they would change their mind about the redundancy?

@startinggrid do you think you can read minds?

No I didn’t think they would stop it but it was a solution my boss gave me - holiday and/or sick note. I was having a tough time and after speaking to my doctor about the work placed stress, my constant suicidal feelings that I’ve been feeling for many months/weeks, which weren’t helped due to CV... I took time of. Anything wrong with that?

@Mmsnet101 oh thanks for the tips about asking for notes/letter. I think they have made a decision so I would prefer to have a note via email as I want to know exactly where we are.
