Desperate, much? You thought the police were going to nail Cummings, whereas they came back and said that if he did anything at all, it was so minor that there was no point in taking any action whatsoever!

Im not desperate. My local official police Twitter was full of people getting sent home/fined all the time for exactly the same thing.

But then they weren't Dominic Cummings so were subject to the rules

Do you believe DC had no other plan than to drive to Durham in the event of illness?

IMHO this about dishonesty and a Gov that is shamelessly prepared to lie.

What court is going to try him? Without that, your ‘conversation’ is going to remain theoretical - and utterly inconsequential.

I didn’t particularly ignore the “unlikely prosecution” quote, I just didn’t see the relevance, as there won’t be any retrospective action.

And again re the speeding - it’s much more clear cut if you are measured exceeding the speed limit, there’s no subjectivity on “reasonableness” as with the Coronavirus Regs. Why do you think the NPPC and the CPS had to issue more specific guidance to police forces on applying the Regulations in mid April?

And Wagner is, to some extent, echoing the other lawyers in that what is reasonable is best proven in a Court.

I work within an ASC diagnostic team and we d always want hearing ruled out so as advised above good first step. To reassure children do very strange things for shirt periods and go on tobe fine. However if regression continues it absoulty warrents assessment and age is not a barrier we diagnosis young children if there is sufficient information. We see regression in other speech and language disorders such as verbal dyapraxia a GP cannot make this call

I didn't say I agreed with Jolyon Maugham (he is upset that Dominic Cummings has not been fined by Durham Police) - I was just pointing out that two well known lawyers were taking a different view on several points.

And Wagner is, to some extent, echoing the other lawyers in that what is reasonable is best proven in a Court.

I agree, although he obviously described his "might have might not have" approach as an outlier.

Fair enough Clavinova, but it’s really only Wagner following the “might have / might not have”, so he is very much an outlier (by his own admission). Every other lawyer I’ve seen so far (including Maugham) is taking the view that Durham police concluded that Cummings broke the law when he drove to/from Barney.

But it would have been fun to see Cummings try the “driving to test my eyesight” excuse in Court.
