AIBU by being annoyed at not being allowed to disclose specific cases of gender pay gap discrepancies?

I know of at least 2 cases where women are paid less than men who work in an equal level role.
AIBU at being annoyed that I am not legally allowed to disclose this as evidence of the blatant gap?

Do you mean in your specific workplace?

Genderpaygap01 · 11/05/2020 19:28

Yes it is in a specific workplace

Are you protected by whistle blower policy ?

YABU this is not gender pay gap but equal pay. I know it can appear to be semantics but in legal terms the difference is key.

Gender pay gap is at organisational level only. The methodology is very specific and uses actual pay. It cannot be used to make an equal pay claim.

Equal pay is where you compare the salaries of two people in the same or equivalent job. The methodology is different and uses full time equivalent salary. Good employers publish both their gender pay gap and their equal pay gaps by job level.

Disclosing individuals salaries is a breach of GDPR. I know it can seem unfair but the person on the higher salary has a right to confidentiality.

There is both a published pay gap and an equal pay gap - I do not know the specific correlation between the two - but I believe that the equal pay gap feeds into the gender pay gap.

My old workplace someone had taken down the details of everyone's pay, presumably gone home (as printer's were all linked to personnel cards etc) and typed up the info, printed off copies. We all just came in to sheets of paper with the full list of everyone's salaries in their cubby holes...

Few folk got pay rises after the stink it caused, me included. No-one was ever found accountable as several with access in finance dept but kudos to whoever was ballsy (and smart enough) to pull it off successfully. Several cases of gender pay gaps and folk in roles working their socks off whilst mates of the boss were getting paid a fortune more than others in same positions etc.

Does your organisation have published pay bands/spine points etc?

OoohTheStatsDontLie · 11/05/2020 20:02

Another poster has pointed out the legalities of it but from a common sense approach, the fact that two men doing a role get more pay than two women doesnt really count as evidence of anything. They may be better qualified, have better results, be more experienced, have the right attitude or whatever behavioural targets they have to meet, have better customer feedback, or they may be equally as good as others who are paid less but they are better at negotiating pay increases. Or they may be beneficiaries of a two tier system that rewards men better than women, but two cases doesnt prove anything

Genderpaygap01 · 11/05/2020 20:12

There are pay bands that have broad ranges and overlap. The two women in this case would be paid more if they were men, perform better, and would have been paid more if they were men with the same experience.
Women not being able to negotiate as well as men seems a poor excuse to explain and settle with the gender pay gap.

Interesting @lynzpynz...a shame it didn't achieve a positive outcome

I know some people use the women not negotiating as well as men to justify gender pay gaps. I'm not saying this, I'm saying some men will be able to negotiate better than some women (as well as the other way around) and that could be the case here

minettechatouette · 11/05/2020 21:50

Well if you get the permission of the four people involved then you can. I don’t think it’s unreasonable that they should be able to withhold that permission though.
