Maintenance

Ex husband and I have sold our home agreeing on the division. My share has bought a home for my son and I. My ex is moving in with a mate currently so will have his sale proceeds as cash. My ex never has our son, sees him about 30 mins a month. He is currently not working. Is it reasonable to ask for child maintenance for our son at this time

Of course it is. Go through CMS though so you don’t give your ex any control of how much or when he pays.

You can ask but you're not entitled to anything because he's not working.

Yes it’s totally acceptable to expect the other parents to contribute financially.
The sale of the house is irrelevant as it’s worked out on income though

Thank you for your replies. I was wondering because he is not working whether it was reasonable to even ask? I have all the care of our son. I wondered if it was a bit of a grey area as he has a large cash sum now and if that made any difference ?

You won’t get much if he’s on benefits but he does still have to pay something, I think it’s £5 a week or something.

Yeah I don't believe cash in the bank will change the amount if you go through the CMS. If you do a private arrangement he might take it into account but no guarantees
