Hello,

My sons father started a residency court case against me last September. Last month, after many terrible, unforgivable acts against me and my child, along with damning CAFCASS report against him, residency was given to me.
My sons dad contacted CSA at the start of the court proceedings and is due to pay money weekly, on a Friday. He did this every week until he lost the court case.
He is now paying on average every 11 days. I believe he is doing this to pay less over the year, but still maintaining he is paying every week (paying on a Monday one week, then a Thursday the next, then a Saturday the next etc).

Do I accrue the days he misses, tot them up when it starts getting to 30 days plus and let CSA know?

He really is a piece of work and so are his family so unable to talk directly to him.
If I speak to his appointed family member who collects my son, I can’t guarantee I won’t be met with aggression so would rather not.

I wouldn’t speak to him about it, I would speak to csa only if you don’t get along to the point you disagree about residency at court, especially as you say you are likely to get an intimidating response.
Just tell them he is paying randomly and what can they do about it?
My csa is due to be paid on a set day each month. Is your not like this?

It says to be paid weekly, starting on a date in September which was a Friday.
Yours makes more sense as there is no deviating from the date of each month.
I’m so shocked at how much thought he puts into getting at me. But then I’m not shocked at the same time, if you get what I mean?
He has put us through the mill, I was very silly to think that the court case would be the end of the misery.

As long as he doesn’t actually skip a week, the total amount won’t change.

Over the year, if he keeps paying every 11 or so days, he would be making 33 payments.
If he pays on time, every 7 days, he would make 52 payments?

You need to document every pay you receive and it's a slow process my sons dad owes over £300 and it's now going through csa as he kept doing the same thing now he has to pay more but I still waiting for money owed x

How long has this been happening for? If it's less than a month then could he catch up? Eg Monday, Thursday, Saturday, Tuesday etc.

Don’t bother talking to him about it, he already knows he’s screwing you. Talk to CMS about it directly. Work out how much he hasn’t paid in the period he hasn’t paid it so you can tell them exactly how much he hasn’t paid as of the date of that phone call. He’s a cunt. Don’t let him get away with behaving like this without putting up a fight.
