Maintenance money

My ex partner is a taxi driver, as you can expect times are bad with everything going on, although he's still working. I've be furloughed and that means I'm already £100 down per week. He hasn't given me any money for the last two weeks. He hasn't brought it up and has just assumed it's ok to not give me anything. I know he can't give me the full amount but I would like contribution. AIBU to expect something?

Cms?

twatbags · 01/04/2020 23:32

I don't think I stand a chance with CMS at the moment and I also imagine he doesn't declare everything but possibly a way to go

Surely as a taxi driver he has more income as people are avoiding public transport? People still need to go to supermarkets. I know the ones by us have averaged what they usually make in a month over the course of a week. I had this very conversation with my uber driver yesterday. Our bus have been reduced to hourly routes and have reduced the amount of people that can get on ine bus for distancing. So the taxis and ubers are making christmas/newyear money from everyone trying to get supplies or going to work and theyre usual bus services are gone. Id be side eying him saying hes making so much less he cant afford his maintenance payments.

Waveysnail · 01/04/2020 23:53

But is he actually working? You cant get money if he doesnt have any

twatbags · 02/04/2020 00:30

@waveysnail yes he's out working

He should still be paying the minimum anyway. Which is £7pw.

My ex paid me £25 today instead of £150pm, without even mentioning it. Not that he'd been paying the full £150 already, as he never increased the payment from £143 when the CMS recalculated it 2.5 years ago.

Plus he hasn't been having our daughter anywhere near the number of nights in the court order over the last year, so he owes me even more really.

He didn't have a job anyway, so this situation shouldn't be making a difference to him. He earned a large lump sum in cash last year working on a cannabis farm in California, which of course he did not declare to the government or the CMS when he returned.

Now he claims he doesn't have any money so can't give me more. And of course I can't prove otherwise.

Obviously doesn't care if his daughter can't eat. Or he's just relying on my partner to support her. Which of course he does, but his wage decreases every year, and prices keep rising, so we need the maintenance as well.

@Pretenditsaplan@ my thoughts exactly. The cab companies down here are booked to the hilt!

Kellylabrant87 · 12/04/2020 02:48

In the same boat here! My ex has been furloughed so I’m assuming is still getting 80% of his wage but is refusing to pay any maintenance until all this is over!

JarOfFarts · 12/04/2020 03:11

I'm in the same boat Kelly.

Do you happen to know if the CMS will take steps to enforce payment after just one is missed?

Hollyhobbi · 12/04/2020 03:20

I really wish we had CMS here in Ireland. Even with 2 Court Orders I don't get one cent from ex dh.

PumpkinP · 12/04/2020 03:31

Even with cms doesn’t mean you will get anything. I haven’t had a penny off my ex for over 3 years, cms can’t do anything.

Kellylabrant87 · 12/04/2020 09:24

I’ve not been through the cms so I’m not sure how it all works, I even said that I know he’s not getting his full wage so I don’t expect full maintenance as wouldn’t want him to struggle but apparently only getting 80% wage means he can’t afford 80% maintenance?! 🧐

Kellylabrant87 · 12/04/2020 09:24

Or any maintenance at all lol

midnightstar66 · 12/04/2020 09:30

Same happened to me - exp just didn't pay my money in and didn't mention it. It's only £30 for 2 dc but I'd precisely covered my rent and bills taking it in to account so it would have been a pain if the agency hadn't messed up and not taken my rent the day it was meant to go out. Fwiw it took cms 18 months to be able to get a payment then he went self employed so back to sq 1. He was only then required to pay £7 a week so went with the private arrangement of £30 instead. It probably isn't worth your time and the £20 set up fee
