To think that they’ve hidden money through Probate.

My sister is executing probate at the moment. Most money was put into the pot and shared, but I suspect that some accounts didn’t come back in time. AIBU to think that she could just provide her bank details and have the existing money put into her account and not tell the rest of us? Is there a way to check?

I'm not sure op and hope someone answers who may know, but curious as to why you suspect this? Has she form? What's giving you that idea? How much do you think might be missing?

I know there were extra accounts thar hasn’t come back, but there has been no mention of them since. It’s possible that the accounts were empty or had been closed, but she hasn’t confirmed and looks confused when any of us ask her Blush

I've been closing accounts recently- I just get asked for an account number and sort code, I could use any one. The amounts have to be reflected on the IHT/Probate forms though.

Probate has officially closed now, does that make a difference?

Bathbedandbeyond · 29/02/2020 14:28

Very true, I guess there’s no way to check either.

How long since the probate was granted?

What do you mean ''didnt come back in time?'' back in time for what?

if there is a will, its her job to execute it, and fill in the probate papers and submit them.
if she knew of the accounts and they were included in the probate, then they should go in the pot, of course.

If she didnt know about accounts at the time of the probate submission, then yes, when they funds are realised they should go in the pot,

This is why executors need to employ a solicitor to do this job. Costs £££££. But it keeps things clear and above criticism.

please remember there are costs associated with the persons death that also have to be met out of the estate many people underestimate what those are.
