Ebay item not as described. What to do?

Ordered a toy for my dc from ebay. It was described as brand new in packaging. Packaging is the type where the front is all plastic glued onto a piece of cardboard (like what a single hot wheels car is packaged in). But when it arrived it was half open. Makes me think it isn't new? Is it worth complaining to the seller?

Worth mentioning it and if you want you can raise a dispute. Could it just be damaged packaging?

Not sure. Cardboard and plastic doesn't look damaged other than it looks like it's been opened.

Maybe they've had it a while so the glue has deteriorated and come away from the packaging? I'd send a message saying it was open and see what they say.

Does the toy itself seem OK? If so, I probably wouldn’t bother with the hassle of returning it for a refund.
