To just leave?

I'm in a job causing dreadful anxiety and stress. I've already been off forb6 months with this last year.
Stress and anxiety is caused by disabled son but made worse by new boss at work and work load.

I've got a new job but current place wont let me leave til end of december. New job are happy for me to start whenever.
Stress and anxiety are back in full flow but old job will not let me leave early . I've explained situation, explained I would have to go back on sick leave if I have to stay as I just cant keep going.
I dont want to have to go on sick leave because last time it led to worsening mental health.i just want to start new job.
Researching it discovered if I did just leave I could be sued?
Aibu to just leave?
Please be gentle with me. I feel in such a fragile place right now.

You've resigned? How long is your notice period? Three months?

Would you get worse if you were signed off but knowing at the end of that period you'd be going into a better job?

Err they don't have a choice. You can leave a job whenever you like for whatever reason.

If they won’t let you leave early then get signed off til December.
Or contact acas/hr and see if there’s anyway to leave before then

Yes I've handed in my resignation.
I just want to go not I'm so worried about being sued.
I think sick leave is the only option

They won't sue you for leaving early (unless you're in a super high payed and important role it's not worth the fuss).

But it would look very unprofessional. If you ever need a reference from them, or if you're in a small industry where word gets around, you might want to stick it out to avoid being known as unreliable.

I work in an academy which is hated un the area of the country I live so I do not think it would matter necessarily what they said to others.
I think I need to see my dr. At this point I feel so stressed and anxious to beyond caring if I have a job at all.

Just leave , I did it at my last job in similar circumstances
