Appealing against a decision made by my insurer and I need an independent medical report in rebuttal. My solicitor rarely returns calls and says he thinks we only need that report until we have failed with the ombudsman. I disagree and feel my insurer is likely to reconsider their decision before the ombudsman even looks, because the medical evidence is likely to be so strong.
I can’t initiate the medical report without instruction from a solicitor as the medical examiners won’t take a referral direct from a patient.
What do I do? Find a different lawyer?
