It's on a par with a story about a woman being arrested for handing her dangerous husband'a guns to the police. Obviously with less tragic consequences as this woman was injured and lost her baby but the same insane logic applies. Only in the US....

@FloatingthroughSpace yes it would be. Pencille clearly has psychological issues, claimed to be hearing voices moments before the attack, also verified by witnesses, and has a history with his mental health I think.

I do not think he will be convicted of murder, but a lesser charge.

Pomeroy was totally unreasonable by the look of it and picked the wrong person to fight with. Still, he shouldn't have died for it, but not many have much sympathy for him from what I can gather. Only his son and the people who had to witness it.

What a great case for abusers this will be ! Finally the victim gets the blame and jail time, while the poor menz will be able to sue her for compensation for making him do it. Thank goodness there is somewhere in the world that has the sense - and courage - to finally say it how it is. I hope he gets compensation for getting blood on his clothes too.

Absolutely crazy isn't it yes civilised people shouldn't be having arguments let alone when they're pregnant however even that person would not expect for the other party to shoot them in response.

or have a few glasses of wine,
or can't give up smoking ?

In fact a fertile woman could be pregnant for months without realising, so maybe you want to forbid women enjoying any of those things, ever

So she is technically responsible for her babies death.

There's so much wrong with this it's difficult to know where to start. But I'll start with.......baby's, not babies!

What bugs me is that this tragedy could almost certainly have been avoided by sensible gun control laws. But the people who allow those laws to stay in place get to condemn someone who is badly injured as a result.

It’s such a slippery slope. What’s next? Eventually we’re looking at a situation where A man beats his wife causing her to lose her baby, she was asking for it as she burnt his dinner, therefore she needs to be charged with manslaughter.

I can maybe Understand the twisted logic of she’d showed up with a gun and then had it wrestled off her and got shot; but surely a logical conclusion of a fist fight is a punch up, not getting shot.

Granted, this is America? But still...

And agree with PP that surely this opens up to pursuing women for ‘child endangerment’ for doing anything even slightly risky whilst pregnant? Given how atrocious access to healthcare is for many Americans, will this include not going to prenatal appointments, regardless of whether they can afford it?

If they want to pretend to give a shit about babies’ lives, they should surely make all pre and post natal care free of charge; and all medical care for children free as well?

Or is this just about controlling women?

I could kind of see the benefit of the law if it was being used to make the point that it's worse to shoot someone who is pregnant than someone who isn't (as in, there's an extra victim) and this could be applied as an aggravating factor in DV, but it's not is it? It's being used to punish the person carrying the baby.

If they're arguing that the mother started the fight so she was shot in self defense, surely they could say that the person doing the shooting killed an innocent victim and therefore was guilty of murder.

You can't say that only the mother was being shot at while simultaneously saying that it's her fault that her baby got hit.

SerendipityJane this is an accurate description of another case in the US that happened this week. Husband tries to run over wife with his car and ends up in jail - told he has to hand in his guns as well. Doesn't do this and the wife (living separately) goes to his place, takes the guns and hands them in to the Police stating that she is scared he will be released and kill her - the officer promptly arrests her for armed robbery(!), breaking and entering and some other stuff. They call the husband in prison and he says he wants to press charges!
