Neighbour parked on my drive

maltesersplease · 20/06/2019 15:50

In February, neighbour/friend gets clamped and fined for no tax, MOT, insurance. Asks if she can park on my drive a few days until she can afford to sort it all out.

We fell out over something else a few weeks ago over something much more serious, and don't speak anymore. Don't need to drip feed, this part's irrelevant.

The car is still on my drive. I've asked her to move it, she says she will SORN it. Car doesn't start either so I can't just move it myself. If she SORNs it, she will never move it! It's still not taxed or MOTd.

So now I seem to be stuck with it on my drive. Each of the police, DVLA and council have told me it's one of the other responsibilities.

I'm feeling really irritated by life in general and if I wasn't worried it would harm a person, I'd have taken the handbrake off it by now!

(This isn't AIBU to remove the handbrake, it's more of a "I'm really fed up can anyone help please?).

Put a note through all your NDN's doors, asking for help on X day at X time. Explain that you can't use your drive because of twatty neighbour and you'd love some help to move it. Oh and make sure you include her!

DoctorDread · 20/06/2019 17:02

We haven't had a CF parking thread for a while!

maltesersplease · 20/06/2019 17:05

@DoctorDread glad to be of assistance

Just take the handbrake off and reverse it onto the road.

Orangeballon · 20/06/2019 17:10

Put a notice on it No Tax DVLA informed. I am presuming no mot or insurance either? I did this and car disappeared within hours.

thenightsky · 20/06/2019 17:10

As a PP said, the finance company would be your best bet.

Gth1234 · 20/06/2019 17:11

the police won't get involved. She's just trespassing on your land. Civil offence.

Darkcloudsandsunnydays · 20/06/2019 17:17

The police are not interested. What makes anybody think they are bothered. The same goes for the local authority, the county council and the Highways Authority. Our streets are rapidly becoming car parks, camping van and caravan sites. They are no longer for driving on. The number of people living in vehicles on the streets is escalating. Nobody does anything anymore. You are stuck with it and she knows it.

Puzzledandpissedoff · 20/06/2019 17:20

it says ... that pushing it into the road would be an offence too

Surely only if it's been SORNed and shouldn't be on the road at all? ... and then it would be her problem as the owner, not yours

Not sure about calling the finance company; they're only bothered about the money and IF she's still paying she'll probably just tell them you've agreed to the use of your drive

TheFlis12345 · 20/06/2019 17:21

Tell her to move it or you will have it scrapped. Odds are that she won’t know you need a V5 (or if she does know, just grin and say “not with the dealer I know” Grin)

tomatostottie · 20/06/2019 17:23

Please don't bump it out onto the street. You might get into difficulties then for dumping this vehicle on the road.
I'd go to a solicitor about this and get proper advice.

cloudyinjune · 20/06/2019 17:25

Get a couple of people to help you push it safely onto the road and then report an abandoned car.

ChristmasFluff · 20/06/2019 17:26

Why worry about damaging it in maneuvering it out? It's not meant to be there. If you are nice, you could warn her.

Notnownotneverever · 20/06/2019 17:28

It doesn't matter how nice the car is or isn't and whether it has finance on it or not. Just arrange to get it moved on to the road and then it will be dealt with by the council as an abandoned vehicle. I can't see anyone or organisation helping you until it's off private property and on to public land.

Littlemisslists · 20/06/2019 17:28

I would contact a local garage to come out with a pick up to lift or tow it onto the road/ her driveway. About £40 worth. After that it’s not your problem.
Any offence that occurs is her problem as she’s the registered keeper

ChristmasFluff · 20/06/2019 17:29

@tomatostottie, how on earth would OP get into trouble for abandoning this car on the road when it is nothing to do with OP????

You don't need a solicitor to understand that this car (that the OP does not own and has no paperwork for) has anything to do with her. Whereas her poxy ex-mate.....

Notnownotneverever · 20/06/2019 17:32

Ah interesting point others have made about getting in trouble for your part in putting the car on a public road. Maybe forget that idea. Perhaps seek advice about whether you can legally claim ownership of the car on your property and then sell it.

Notnownotneverever · 20/06/2019 17:33

Try the CAB office for advice.

John470322 · 20/06/2019 17:33

Demand that the police act. If they say it is private land ask if it is ok for you to murder your neighbour on private land. Obviously not so they can act on private land if you push them.

Goldmandra · 20/06/2019 17:35

Find out how parking companies can fine car owners and see if you can follow the same process?

MrsSpenserGregson · 20/06/2019 17:35

I'd bump it into the street, because where's the proof that it was you who did it? Do it at night. No proof whatsoever that it was you.

Troels · 20/06/2019 17:35

Put it onto the road in the dead of night, no witnesses to see it done. You didn't do it so far as anyone else is concerned. Not your car, not your problem.

azulmariposa · 20/06/2019 17:37

Surely if it has finance on it she couldn't SORN it?
I'd call the finance company and see if they would remove it. If the cars no good she might not have been paying for it.

Rollercoaster1920 · 20/06/2019 17:38

Can you roll it into her front garden? Like this:

No need for the lycra outfit, or moody staring though.

Puzzledandpissedoff · 20/06/2019 17:38

I take back what I said earlier - it seems you can get into bother for moving a car that's not yours off your drive, so what the heck's anyone supposed to do when it's private land and neither the police nor the council are interested? Hmm
