Neighbour parked on my drive

maltesersplease · 20/06/2019 15:50

In February, neighbour/friend gets clamped and fined for no tax, MOT, insurance. Asks if she can park on my drive a few days until she can afford to sort it all out.

We fell out over something else a few weeks ago over something much more serious, and don't speak anymore. Don't need to drip feed, this part's irrelevant.

The car is still on my drive. I've asked her to move it, she says she will SORN it. Car doesn't start either so I can't just move it myself. If she SORNs it, she will never move it! It's still not taxed or MOTd.

So now I seem to be stuck with it on my drive. Each of the police, DVLA and council have told me it's one of the other responsibilities.

I'm feeling really irritated by life in general and if I wasn't worried it would harm a person, I'd have taken the handbrake off it by now!

(This isn't AIBU to remove the handbrake, it's more of a "I'm really fed up can anyone help please?).

Oh well, it would have been far too easy!

tomatostottie · 20/06/2019 19:36

www.askthe.police.uk/content/Q441.htm

They don't recommend that you bounce it off onto the road as you could be committing an offence.
And they recommend seeing a solicitor.

You could say to the neighbour that they have x days to remove it or you will be pursuing this in the civil courts and she would be liable for the legal costs.

tolerable · 20/06/2019 19:42

use a free vehicle checker-might show finance?...or report it as abandoned?

Puzzledandpissedoff · 20/06/2019 19:42

she doesn't have a drive

She does now ... at least in her own mind Hmm

MustShowDH · 20/06/2019 19:43

Nothing helpful to add as you've had some good advice already, but if you wanted to do something IMMEDIATELY to make you feel better, you could start using it as a bird table. Some nice bread and fruit to make them shit all over it!

frogsoup · 20/06/2019 19:47

Shock at the astounding arrogance of objecting to uk posters on a uk site using standard uk abbreviations.

Snausage · 20/06/2019 19:56

I would:

  1. Find a towing company and find out how much they charge you (to tow; it could be free as they will charge impound and release fees). Also find out how much their daily rate is for impound and the release fee.
  2. Put a notice up (with the date) with the fee details on it, saying that from this date (2 days or something) any permission for (her reg) to park here has been withdrawn.
  3. Take a photo and include it in a written letter, stating the same.
  4. If it's still there, you get a tow company to remove it and it's all up to her.

The above sounds like a faff, but will make sure that you're covered.

Alternatively, the rugby team sounds like a good plan!

Itsnotme123 · 20/06/2019 19:56

But you say the car has been clamped ?? On your drive ???

Drum2018 · 20/06/2019 20:00

I work for a vehicle finance company dealing with issues like this every day

Call them, tell them it's been abandoned on your property. The mere fact that it's not taxed / MOTD and probably not insured (you can check on askmid.co.uk) will be a breach of the Ts and Cs of the agreement. They will class it as 'at risk' and will happily collect it from you, whilst also terminating her agreement

This seems to be the way to go - good luck and hope the Finance Company take heed and remove it.

TypicalMeBreakMyTypicalRules · 20/06/2019 20:03

My friend towed a car parked across his driveway with his Mercedes with no problem (hand break on). Know someone with a car with a big engine?

RedHatsDoNotSuitMe · 20/06/2019 20:12

6 pages and no diagram? standards are REALLY slipping on MN these days.

(perfect advice it seems from @googlegoals so no need for me to add anything else)

DoctorDread · 20/06/2019 20:14

I really hope @googlegoals solution has legs OP. Fingers crossed for a happy result.

Crankybitch · 20/06/2019 20:17

Start putting bread on it each morning for the pigeons.... use it as a large bird feeding table... once it’s covered enough she will move it

You could also throw bird seed on - some might find its way into the nooks & crannies and start growing.....

thinkfast · 20/06/2019 20:19

Email the finance company. Tell them it has been abandoned on your drive and ask them to come and collect it. Tell them if you don't collect it you will arrange for the council to remove it

googlegoals · 20/06/2019 20:22

Be sure to keep us updated (I'm sat here wondering if it's the company I work for!)

maltesersplease · 20/06/2019 20:22

@Itsnotme123 no it was previously cramped. She paid to be released then moved it to avoid paying / being clamped again.

@RedHatsDoNotSuitMe I was waiting for that! It took so long for someone to mention it!! It's just two cars side by side. Mine next to hers, which used to be a lovely blank space in which I could get in and out of my car...

maltesersplease · 20/06/2019 20:24

@DoctorDread @googlegoals me too. Can't call until tomorrow. This thread will be 90 pages by then

RedHatsDoNotSuitMe · 20/06/2019 20:27

@maltesersplease I've never been on a parking thread without most of the PPs clamouring for a diagram and mentioning penguin bollards by half-way down the first page!

It would be useful to see why the car can't easily be pushed off your drive, though. Is it very narrow?

tierraJ · 20/06/2019 20:31

Scare her into moving it.

I did this when a CF visiting down the road parked on my drive.
I rarely lose my temper but I lost it in this situation.
I was like "get your fuckjng car off my drive now!!!"
He said "calm down love" which was not the best response.
I shouted if you don't move your fucking car I'll move it for you.
He moved it immediately...

Happily my next door neighbour who has the adjoining drive was watching & said "I wouldn't want to get on the wrong side of you" which is good because she'd had CF neighbour tendencies for a while.

GreatOne · 20/06/2019 20:31

I havent rtft, have you actually asked her directly to move it?

Homeallday · 20/06/2019 20:34

GreatOne maybe rtft rather than expect OP to answer someone who can’t be arsed to rtft

maltesersplease · 20/06/2019 20:49

@RedHatsDoNotSuitMe I only have half of the kerb dropped as I only use half the drive 🙄. It was sooo hard to push it on there in the first place, to get it reversed out and across the street (so it's not blocking other drives), across a busy road, would be very tricky.

OP posts:
maltesersplease · 20/06/2019 20:50

@GreatOne we aren't speaking and she gets very dramatic if I attempt to speak to her when she's in her current mood so cba with the drama. I've emailed her, thought it was better to have a paper trail anyway, and she's told me where to go.
