to ask what to do now? The bank have given my details to abusive ex...

AnchorDownDeepBreath · 14/03/2019 11:25

I made a complaint to the bank a few months ago that they had allowed an abusive ex-partner to open an account in my name and run up debt. Three weeks later, they were still allowing him to use the account (according to my credit file) and I complained again.

Today I messaged them to ask what was taking so long. They've just called and confirmed that they sent a letter, including all the allegations, to his address. An address that I have never lived at. The letter contains my new mobile number, at least, and possibly my new address.

He was very violent. He hit me when we broke up. I had to get the police involved and be escorted to work and home again for a while, had to work odd hours, he waited for me outside anywhere he thought I might be. I had to go into a refuge for a while and get a new number. It took months for me to feel calm that he didn't know where I was. I was treated for intense PTSD, and situational anxiety.

They knew this. I was explicit about this, and they knew it, and have detailed in the letter that they know they can only use certain contact details for me...

The bank complaints handler has apologised and said they will call back today as soon as possible. He shut down and wouldn't tell me any more.

What do I do now? I don't want to keep running, to live in fear again. It cost a lot to deal with it last time, there's a lot of inconvenience... I can't believe they've messed it up. I'm so scared he'll turn up here.

When you put in a compensation claim make sure it's clear that this is not a final claim and you will ALSO be pursuing further, continuous remedy for financial costs incurred and emotional distressed suffered - to an unlimited extent - based on any future events that occur as a result (direct or indirect) of this breach, with an unlimited timescale.

I'm sure the legal people here can give you good advice.

Barclays' complaints process is a mess. Go in hard.

Sorry you're going through this.

qazxc · 15/03/2019 11:13

I am so shocked that having made such a big mistake they are being so blase and uncooperative.
Why can they not e-mail you a copy of the letter so that you know what information your ex has had access to?

TheMuminator2 · 15/03/2019 11:15

Have they confirmed if your address was on it too? or just mobile no?

Hotterthanahotthing · 15/03/2019 11:23

My local council did similar this week.Sent my address and council bill to my ex.I have lived here for 3years,he should not be linked toy account but someone found our old address with his forwarding address ,slapped it on my account and sent everything to me.
I got a sorry it won't happen again.
I have a direct no. to call the police and I'm hoping he's too idle to make the long journey to get to me.
Hope your OK Op.

In addition to all of the excellent GDPR advice you have been it is worth pointing out that this is fraud:

-Report to your bank's fraud department
-Report to Action Fraud
-Consider getting a CIFAS Protective Registration (www.cifas.org.uk/services/identity-protection/protective-registration) This will make it harder for anyone (including you which is why you should think about it) to open any financial account in your name.

Surely they will have to compensate you for a house move? A possible job move, or at least one of those personal alarms that tracks your movements to and from work?
Possibly a new car? If you don’t move then a panic bottom in the house and some sort of safe room.

Moving house and job seems to be the only way to be completely sure that your ex can’t find you? Which means they will owe you a lot of compensation!

sisterofmercy · 15/03/2019 12:13

This is a breach of your data protection rights with a risk of serious harm to 'your rights and freedoms' (GDPR) . Their data protection officer should be investigating this as they should have reported to ICO within 72 hours. Barclays DPO address is The Data Protection Officer, Barclays Bank UK PLC, Leicester, LE87 2BB or [email protected].

thetemptationofchocolate · 15/03/2019 13:29

OH worked in banking for many years and he says that opening an account in someone else's name IS fraud, and breaches every rule in the banking book (especially as the banks are supposed to be helping to tackle money-laundering). He says you 'can take them to the cleaners' for that alone.
Barclays have done so much wrong here, and whilst I'm not always a 'sue the bastards' advocate, I think in this case they need a financial shock to make them wake up to the damage they've done.

SaveKevin · 15/03/2019 13:38

I am so sorry, i had an incredibly similar thing with Natwest (my ex also managed to clear out my account despite it being solely in my name). They didn't give a shit either, I was too upset to deal with the complaints procedure any higher although it clearly deserved it. Luckily my ex didn't do anything other than drive past my new address.
Good luck with the police, do take this further with the ICO if you can face it Flowers and compensation for changing your phone number etc.

AverageAvenger · 15/03/2019 13:43

I hope you’re ok today OP.

Personally, I think Barclay’s should buy you a new FUCKING HOUSE if they’ve given him your address. Seriously.

MRex · 15/03/2019 13:45

I hope you're ok OP. I agree with emailing the CEO (www.ceoemail.com/s.php?id=ceo-10648), Barclays are at fault and should be doing everything they can to make you safe again, then giving you compensation for the fear and stress.

AnchorDownDeepBreath · 15/03/2019 14:51

Barclays have sent me an email today, saying they are investigating at a senior level and will get back to me. Nothing else. They haven't provided the police with the letter yet so I still don't know exactly what was contained. They also haven't confirmed if they have reported the breach.

I've contacted a few of the solicitors that people have mentioned, to see if they will help me. I'm having to stay away from home, work or anyone he knows today; which generally means a lot of moving around random coffee shops.

I'm numb. Some of my close friends are having security briefings from the police today incase he turns up looking for information about me. It all feels so surreal.

I'm beyond shocked and disappointed at how Barclays have responded thus far.

I think you should demand they put you in a hotel.

PopWentTheWeasel · 15/03/2019 14:58

Anchor they only had 24 hours to report the breach so they should have reported it by now. Please do report it yourself via the ICO website. Under GDPR they can get a huge fine for something like this where they've put your safety at risk and aided fraud.

TheHodgeoftheHedge · 15/03/2019 15:02

Anchor, very relieved to hear you’re ok and I’m so sorry you’re living this nightmare. I really hope you get some answers soon and some peace.

TheHodgeoftheHedge · 15/03/2019 15:04

Ps I think Sun is right, the least they should be doing is putting you up in a hotel.

Motoko · 15/03/2019 15:07

So, not only have they caused you distress and probably loss of money, they've also caused the police to have to put in a lot of work, that had they done their job properly, wouldn't have been necessary.

I hope the ICO come down really hard on them, and make them pay for everything.

AnchorDownDeepBreath · 15/03/2019 15:38

Thanks PopWent, I didn't know that.

I'm in my fifth location of the day. It seems so stupid. It's like living a bad novel. I have to inform someone from the police whenever I move. I've got such a bad headache and this place is rammed, it seems everyone in the world is having a loud interview in here.

I'll report to the ICO now. I am really shocked that I still haven't heard back. The police were cautious about me using any social media at all given the situation, or I'd have tweeted this to them... They just don't seem to care Angry Sad
