to ask what to do now? The bank have given my details to abusive ex...

I made a complaint to the bank a few months ago that they had allowed an abusive ex-partner to open an account in my name and run up debt. Three weeks later, they were still allowing him to use the account (according to my credit file) and I complained again.

Today I messaged them to ask what was taking so long. They've just called and confirmed that they sent a letter, including all the allegations, to his address. An address that I have never lived at. The letter contains my new mobile number, at least, and possibly my new address.

He was very violent. He hit me when we broke up. I had to get the police involved and be escorted to work and home again for a while, had to work odd hours, he waited for me outside anywhere he thought I might be. I had to go into a refuge for a while and get a new number. It took months for me to feel calm that he didn't know where I was. I was treated for intense PTSD, and situational anxiety.

They knew this. I was explicit about this, and they knew it, and have detailed in the letter that they know they can only use certain contact details for me...

The bank complaints handler has apologised and said they will call back today as soon as possible. He shut down and wouldn't tell me any more.

What do I do now? I don't want to keep running, to live in fear again. It cost a lot to deal with it last time, there's a lot of inconvenience... I can't believe they've messed it up. I'm so scared he'll turn up here.

They definitely like to make things worse for themselves.... Imagine the icos reaction when they find out that not only have they not reported it, they're reducing it down to something similar importance to say their app going down for five mins.

How wrong they are....! I'm so sorry op

She did not know if this had been reported to the ICO, as she believed it was just human error, but she hoped to give me a response on both fronts today.

If Barclays staff seriously think they don't have to report data breaches if they are "just human error" they need urgent retraining. Plus, there is a whole chain of errors here, including the fact that initial complaints handler though it was OK just to put your complaint into a queue, and that they have taken two weeks to investigate something that, had they properly prioritised it, they could have fully investigated within two days.

But please don't wait for them to report to the ICO, you can do it yourself. ico.org.uk/make-a-complaint/

Hi all.

No real updates, I'm still waiting for the letter from Barclays that finalises their conclusion and allows me to go to the FOS. The solicitors would like to see that first before proceeding. I just hope they've sent it to the right address...

I've reported to the ICO in the meantime, and I'm grateful for all your support and thoughts. I've got an operation tomorrow (only a biopsy, but worrying all the same) so I'm going to focus on getting through that and then worry about everything else (like work) next week.

I'm so exhausted over it all.

Op - I've been reading since the start but didn't have any real suggestions so haven't posted before.
I am sickened by how you have been treated, DH had dealings with Barclays 20 years ago and won't go near them now.
I hope the biopsy goes well and that you can start to get some semblance of normality back soon.

A small aside in all this - it’s all very well them saying they’ve wiped the fraudulent account with no charge to you but you want to make sure that that they do go after your ex and recover the money he spent as well as punish him for the fraud. If he ends up in prison for his actions, so much the better as he won’t be able to harass you. If they don’t punish him, he will have got away with £££ which is effectively rewarding him for doing it - which means there is a good chance that he will try this again - he’s just seen he has nothing to lose!

OP one of the major banks has mixed my friends and her ex husband details and send private information to him. It was before GDPR. It was nowhere near as serious as your situation.
My friend made a complaint with the bank and they offered £150 compensation. My friend though it was insufficient and complaint to the ombudsmen. She got £500 and an apology from the bank.

Good god have just found this thread and have read it all. Am appalled.

So much good advice here. You are a better person than me op, I would have gone in to my branch like a crazy banshee and not left until they took me seriously ( or threw me out ) and I hope you get a massive apology, excellent compensation and that your ex contracts the plague.

I checked today whether the letter from Wednesday had been sent to the wrong address as I haven't got it. Very nicely, just checking.

They haven't sent it yet. It will "hopefully" be written this week.

Honest to god, I think I'm losing my mind.

I think you need to contact their Data Protection Officer again if you still haven't heard anything from them. I certainly need to apply more regular pressure. Although I appreciate that going through a difficult time it might not be possible to do that. My most successful complaints have been where I have been consistently annoying.

I reckon this letter is sitting in the "too difficult" pile on someone's desk.

Some poor sod has the job of drafting a reply that doesn't say

"Sorry, we've fucked up really badly and are reporting ourselves to the ECO, training our staff so they don't spout "human error" bollocks and revising our procedures so this never happens again.

Please send us a list of your out of pocket expenses and we'll remiburse them in full asap. Will a further £xxxx in compensation be satisfactory compensation?"

.... while not straying too far from the truth.

Still no letter. A few solicitors were sent to me via DM on here and one of them has offered to take the case on as no win no fee, but they need the letter from Barclays to get started. As do the ICO.

On Monday they were "hopeful" that it would be written last week, yesterday they were "unaware of the cause of the delay" but couldn't confirm when it would be sent.

I am home, at least. Still very jumpy. Police have been wonderful, faultless for the most part.

I'll email the DPO again, see if that helps.
