Annual leave when signed off work sick

Posting here for traffic mainly.

Does anyone know if you can use remaining annual leave when off sick to bump up SSP?

Yes you can. I did it as I’d accrued a lot of leave whilst sick. HR suggested it.

bluefpg · 11/02/2019 12:28

@MatildaTheCat brilliant, thank you!

No we can't. Absence through illness is managed completely differently.

bluefpg · 11/02/2019 12:35

@HollyBollyBooBoo ah no way, I keep hearing two different things Sad

I'm pregnant at the moment, suffering from SPD and what I suspect to be anemia (going to GP this afternoon to discuss).

The thing is, im feeling really stressed with work and don't feel as if I can face it for those last few weeks. I want to put myself and baby first and the stress levels are really a contributing factor as to how I feel right now.

I was hoping to explain everything to GP this afternoon and get signed off until 36 weeks where I'd be taking mat leave but wanted to use my remaining annual leave to increase pay whilst off

You poor thing - horrible!

Might it be company specific then?

For what it's worth no company can start a disciplinary for pregnancy related illness but of course that doesn't help your SSP situation.

Don't get stressed Thanks

Reallyevilmuffin · 11/02/2019 14:51

It's different when pregnant. There is a mechanism I think where they can get you to take matters leave early I think.

Justgivemesomepeace · 11/02/2019 14:55

We cant. We are either off sick or on holiday. If we have prebooked holiday and are sick we get the days back. We cant be off with both. If we are off sick at the end of the year and have hols left we can roll the days over to next year.

AnchorDownDeepBreath · 11/02/2019 14:57

It's company specific, hence the different answers here. It's definitely worth asking.

PlainSpeakingStraightTalking · 11/02/2019 15:05

You are either on annual leave or on sick, not both.

It doesn't work like that, say you want to be off one month before the birth and have 10 days annual leave - you would take 10 days holiday THEN your maternity leave would kick in after that. SSP would be paid BEFORE annual leave and SMP.

bluefpg · 11/02/2019 15:27

This is on Maternity Action website.

Or is it still at the company's discretion?

You accrue holiday pay when you are off sick and the company can either pay this as it is accrued or save it for when you come back
We had an employees who was off on very long term sick and this is how we chose to apply it

bluefpg · 11/02/2019 15:37

@pelirocco123 thank you Thanks
