To think this employer is taking the piss ?

My 17 yo attended an interview on Saturday. The position was for Shop Manager (it’s an independent food based shop).
Hours, holiday, pay etc was discussed. My son would be opening/closing the shop, cashing up at EOD , 6 days a week. He would be working on his own with no lunch break 10-6.
He was successful & received his contract last night.
The employer has removed any paid holiday (agreed 28 days in the interview), his salary would be £200 a week & 2 days paid training to be paid back if he leaves within 12 months .
It’s taking the piss isn’t it ?

That’s what I thought. He has emailed the employer & is waiting to hear back.
He’s a bit desperate for a job but not this desperate. The employer has cameras everywhere in the shop & texts the staff if they sit down for a minute.
The shop looses money in the Winter because it’s a Summer based product but shut the shop rather than employ under these conditions!

no break
no annual leave
less than minimum wage
not sure about paying the training back

I understand the minimum wage but this is not a minimum wage job. He would have the keys to the premise, no break & cashing up.

60 hrs pw at £200 is £3.33ph, so below the NMW for his age (£4.20). And if my memory serves me correctly, he's legally entitled to 20 days paid holiday per year, although this may include BHs - happy to be corrected on that one, though!

What do u mean "this isn't a minimum wage job"? I thought all jobs had to pay at least minimum wage.

Total puss take. I would query it first of all, ideally in writing via email but not all guns blazing. If the owner is indeed a CF the I’d be turning the job down and reminding him of his legal obligations regarding rest breaks for the under 18s and over 18s, statutory annual leave and minimum wage as I did so.

I think the fact that this person is even considering a 17 year old with presumably little experience for a Managers job says it all about the kind of operation they are running - they just want as cheap as possible and to get away with as much as they can. Your son should run a mile

Massively taking the piss. All that responsibility for less than £4 per hour. No way. Hope your son lands another job soon. Tell shopkeeper to take a hike.

The only bit that’s dodgy legally is the no lunch break and potentially lone working. He’s entitled to a 20 minute unpaid break. He’s getting more than the required weekly break and 48 hours per week is okay.

I’m sorry- I meant ‘this is not a minimum wage job’ because it was advertised as Shop Manager. I phrased it badly.

He’s entitled to breaks, and holiday leave even if an apprentice.

At 17 the NMW is 4.20.

At 17 he cannot legally work more than 40 hours per week

At 17, if he works 10-6 he legally has to have -3 hours between shifts so the next working day he would start at 11am

At 17 he legally has to have 2 days rest breaks

At 17 also cannot legally lock up a premise as in the eyes of the law your classes as a minor (employment law and insurance).

Ha, just realised I've done my sums wrong, and he's not being underpaid legally 😳. But the lack of holidays and breaks is illegal.

I also agree, the moment they are interviewing an inexperienced 17 year old for the job, then the writing is on the wall. It doesn't matter what they call it, it's a shit job.

However, it's not easy to get a job at 17 and with what will be little qualifications due to his age. As such, it could be very beneficial for him to take it then try to find another.its easier to find a job when in one.
