Neighbour stole our woodland?

Our DGrandad left me and my sister his woodland when he passed away a few years ago. It isn't anything that special (as in its not protected and hasn't any distinguished species) but does have a TPO on a couple of trees. It is a place that my sister and I visit occasionally and thought that perhaps we could use it as a place to "wild camp" with the kids this summer for a few weekends. Even had insipiration from what George Clark created in a piece of woodland in his series Amazing Spaces and thought maybe one day with enough money we could do the same.

Anyway, we went down there this weekend to have a look to see if we could maybe clear a patch for a good tent destination, Thought it be good to do this now before everything starts flourishing in the spring.

To our shock it's all been fenced off and there has been some very obvious clearing of trees and shrubs! We knocked on the nearest house to ask what's happened to our woodland and the couple that lived there informed us that they have now taken it as their own and have started keeping it in order for past couple months. They said that it now makes our land legally theirs?

Obviously we shall be seeking legal advice but in the meantime, can what they claim actually be correct?

Just seems so unfair? Surely that would mean I could just fence off any land and claim it as my own?

Even at the time we were laughing at the cheekiness of him! He was just so blimmin arrogant about the whole thing! But we had the last laugh. He had no idea we were planning to sell as we had had huge problems with kids on the footpath beside the house and had made so many calls to the police one of them even said it would possibly affect our ability to sell the property if interested buyers did a search. As it was we sold for over twice the original price within 3 months and bought our current rather lovely home that we would never have been able to do without his help 😊

I agree with pp- they are definitely hoping the land will get planning permission in ten years or so. Sounds like it’s near a road with other houses nearby so a likely bet.

I know someone who did this. Erected fence around common land and declared they had a farm.

Plain robbery! That's shocking. I don't know anything about the law on this but any law that allows you to steal other people's land is truly astounding. Hope you get it back and with a stiff penalty to them. Can you get some sort of wildlife expert in to see whether they have broken any wildlife laws?? (newts/rare flowers etc)??

Surely if they have been felled then a felling company would have checked first or at least have records that it was the neighbours that contracted the work and not us?

You’d think, but our NDNs In London paid a company to cut down a tree in their garden with a TPO on it. They certainly didn’t bother checking first.

I always look at woodlands for sale never realised I could just fence one and claim in ..... any know of any in Regent’s Park? I quite fancy that postcode.

I hate it when you get things like this on days you can’t do anything. You just sit there getting angrier.
Is the land insured? Just thinking of legal cover on the insurance.

I know quite a few tree surgeons, they just do what they are told. I’ve heard of them not getting involved in obvious disputes... although I’ve then heard the name of the person who has done it come up.

I’m so angry for you op, our woods are precious and although don’t need maintaining in a garden way they do need to be managed. I’d also be very surprised if you didn’t have species that are in trouble there. Although councils and developers don’t tend to give much of a shit when it comes down to it.
