Neighbour stole our woodland?

Our DGrandad left me and my sister his woodland when he passed away a few years ago. It isn't anything that special (as in its not protected and hasn't any distinguished species) but does have a TPO on a couple of trees. It is a place that my sister and I visit occasionally and thought that perhaps we could use it as a place to "wild camp" with the kids this summer for a few weekends. Even had insipiration from what George Clark created in a piece of woodland in his series Amazing Spaces and thought maybe one day with enough money we could do the same.

Anyway, we went down there this weekend to have a look to see if we could maybe clear a patch for a good tent destination, Thought it be good to do this now before everything starts flourishing in the spring.

To our shock it's all been fenced off and there has been some very obvious clearing of trees and shrubs! We knocked on the nearest house to ask what's happened to our woodland and the couple that lived there informed us that they have now taken it as their own and have started keeping it in order for past couple months. They said that it now makes our land legally theirs?

Obviously we shall be seeking legal advice but in the meantime, can what they claim actually be correct?

Just seems so unfair? Surely that would mean I could just fence off any land and claim it as my own?

I'm not updating as there isn't really anything to say. These things take time and as I am in my 1st trimester I really have 0 energy atm!

But, I can say, I'm waiting for my sister to go see the solicitor again about the next move which I believe will just be another letter so nothing exciting

OP, what did the first letter to the CF say? Did it ask for removal of the fencing and give a timeline for this?

What is the position on the trees that have been removed? Were any of them subject to a TPO? Did the letter mention this?

Ooh yes a diagram would be great. I’m trying to figure out what they have done. Have they just extended their garden into your woodland? Have they taken the whole lot? How big is it? Are they a remote detached house/cottage or something?

Hello,

So update again.

I havent been to look, DS has the flu so been tied up with him.

But my sister went down and spoke to the other neighbours around. Apparently the CF has fenced in part of someone's woodland garden along with our woodland! They've also written a letter to the CF too.

Fences are still up! But sister managed to get herself into our wood and reckons the TPOs have certainly been left (thank goodness!!) but a lot of clearing has been done.

Also attached is a very rough diagram

ask your solicitor on the legalities of removing their fence. By the way what type of fence is it- does it have concrete posts?

I can't believe they left the fences up, I want them to go to court for damages now just to know what their explanation is. (Sorry, I know that's hassle for you do you won't want that OP.)

I can't believe the sheer brass neck of the CF neighbours. I hope there's scope for joint action with the other neighbours who are also victims of the wood thieves.

I'm wondering if this means Cheekyfuckerfest is still on when the weather warms up a bit?

Are you not tempted to buy a cheap scruffy old caravan or motorhome to park on the land for a while? 😀
Make sure they can see it from their house if poss.

They must be competing for CF of the year! I can't believe (well I can but I am shocked) that they dared to try to take part of the garden of a house as well.
I hope your son is better soon.
