Neighbour stole our woodland?

Our DGrandad left me and my sister his woodland when he passed away a few years ago. It isn't anything that special (as in its not protected and hasn't any distinguished species) but does have a TPO on a couple of trees. It is a place that my sister and I visit occasionally and thought that perhaps we could use it as a place to "wild camp" with the kids this summer for a few weekends. Even had insipiration from what George Clark created in a piece of woodland in his series Amazing Spaces and thought maybe one day with enough money we could do the same.

Anyway, we went down there this weekend to have a look to see if we could maybe clear a patch for a good tent destination, Thought it be good to do this now before everything starts flourishing in the spring.

To our shock it's all been fenced off and there has been some very obvious clearing of trees and shrubs! We knocked on the nearest house to ask what's happened to our woodland and the couple that lived there informed us that they have now taken it as their own and have started keeping it in order for past couple months. They said that it now makes our land legally theirs?

Obviously we shall be seeking legal advice but in the meantime, can what they claim actually be correct?

Just seems so unfair? Surely that would mean I could just fence off any land and claim it as my own?

Why should op offer money, its their land

Because you need a consideration to form
a contract; in this case a contract of sale.

I'd be far more inclined to tell them that either they remove the fence or you will get it done and they will have to pay the bill.

I’m guessing they haven’t removed the fence. Fencing can be expensive.

I've got a small woodland. Fencing is determined by who does what on the deeds. We have to fence one side, but not the other. Check your deeds!

@TwittleBeeTake take the fencing down and knock on the door ask them if they would like it returning to there driveway, but get it on record...

How about writing something like this:

"Dear Neighbours
Now that it has been firmly established that Twittlebee Wood is our property and can't be simply taken, I do hope we can return to being good, cordial and friendly neighbours to one another with no hard feelings. In that spirit, there does remain one open question. Whilst the woodland is, and shall always remain our private property, the fencing you have erected was bought at your expense. As you then chose to place it on our property, we believe it could legally be considered a gift to us - however, we acknowledge that fencing can be expensive and this gift to us was not intended. Therefore we hereby give you notice that you have 6 weeks notice to remove this fencing from our land if you wish to keep it. If the fencing is still in place on (date) we will consider it to now be our property and any action taken by you regarding our land or the fence around it will be pursued in the courts to the full extent of the law.

The "friendly neighbours" have cleared an area in the woodland by removing shrubbery and felling trees - possibly with TPO's on them.
On the whole, they sound pretty difficult and arrogant.
I hope I'm wrong, but this could get worse before it gets better.

Wow. I can hardly believe the cheek of those people. I'd rip the fences up and use them to make a campfire when you camp there in the near future. Hopefully the smoke doesn't bother them ;)

I so want an update to this!

I would love some woodland (poverty prevents my realising The Dream), and I can only imagine how upsetting this must be for the OP.

OP: Xenia is a solicitor of long-standing on MN, so her advice is sound. Otherwise check back with the solicitor you spoke to about the fencing.

However CF the neighbours you need to stay lawful and not give them any leeway, so I wouldn’t resort to DIY solutions without checking.

Twittlebee Wood does have a rather nice ring to it. Explaining the etymology of the name in about a hundred years will keep the 22nd century version of Facebook busy for ages!
